The [[[]]clerks of the circuit courts for the several counties and the clerk of
the Superior Court of Baltimore City [[]]] [[SECRETARY OF STATE]] AND
THE DEPARTMENT OF ASSESSMENTS AND TAXATION, shall [each]
keep a public [docket,] RECORD, to be known as the "agency record," wherein
shall be recorded all certificates filed in accordance with the provisions of § 18 of
this article properly indexed so as to disclose the name or names of the real owner
or owners of such business and the name, title or designation under which the same
is conducted, and shall charge and receive a fee of [two] TEN dollars for
recording such certificates and [twenty-five cents] ONE DOLLAR for each name
to be indexed[[.]] AND SHALL FORWARD FIVE DOLLARS ($5) OF THE
FEE SO CHARGED TO THE DEPARTMENT OF ASSESSMENTS AND
TAXATION.

(h) The term "trade name" means a word, name, symbol, device or any
combination thereof used by a person to identify his business, vocation or
occupation and distinguish it from the business, vocation or occupation of others.
Trade names shall [not] be entitled to registration under the provisions of this
subheading[.] AND IN ARTICLE 2, SECTIONS 18 AND 19 OF THE
ANNOTATED CODE OF MARYLAND.]]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
