CHAPTER 789
(House Bill 587)

AN ACT to repeal and re-enact, with amendments, Sections 18 and 19 of Article
2 of the Annotated Code of Maryland (1968 Replacement Volume and 1972
Supplement), title "Agents and Factors," subtitle "In General," [[and Section
90(h) of Article 41 of the Annotated Code of Maryland (1971 Replacement
Volume and 1972 Supplement), title "Governor—Executive and Administrative
Departments," subtitle "The Executive Department," subheading "Secretary of
State," to provide for the filing of the certificate of true and correct ownership
of businesses with the Secretary of State, and for the Secretary of State to
receive and keep on record the trade names certified by it for a fee of ten
dollars ($10) for recording the certificates and one dollar ($1) for each trade
name indexed.]] to provide for the filing of the certificate of true and correct
ownership of business with the clerks of certain courts and the Department of
Assessments and Taxation and to provide a fee of ten dollars ($10) for
recording the certificates, to be divided between the Department of Assessments
and Taxation and the clerks and for the [[Department of Assessments and
Taxation]] clerks to receive and record the trade names certified by it for a fee
of one dollar ($1) for each trade name indexed.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 18 and 19 of Article 2 of the Annotated Code of
Maryland (1968 Replacement Volume and 1972 Supplement), title "Agents and
Factors," subtitle "In General," be and they are hereby repealed and re-enacted,
with amendments [, and that Section 90(h) of Article 41 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title
"Governor-Executive and Administrative Departments," subtitle "The Executive
Department," subheading "Secretary of State," be and it is hereby repealed and
re-enacted, with amendments, and all]] to read as follows:

ARTICLE 2.

18.

Any person or persons, engaged in any mercantile, trading or manufacturing
business as an agent or agents, or doing business in any name or under any title or
designation other than his or their own name or names, shall, within thirty days
from June 1, 1922, or thereafter prior to commencing such business, file in the
office of the [[[]]clerk of the circuit court for the county wherein such business is
conducted, or in the office of the clerk of the Superior Court of Baltimore City, if
such business be located in said city] [[SECRETARY OF STATE]] AND
WITH THE DEPARTMENT OF ASSESSMENTS AND TAXATION, a
certificate in writing, under oath, disclosing the true and correct name or names
and the address or addresses of the principal or principals or true owner or owners
of the said business, the character and location thereof and the name, title or
designation under which said business is conducted, the form of which certificate
shall be as follows:
