(House Bill 94)
AN ACT to add new Sections [[84 and 85 to Article 88A of the Annotated Code
of Maryland ([[1968]] 1969 Replacement Volume), title "[[State Department
of Social Services]] Social Services Administration," to follow immediately
after Section 83 thereof, and to be under the new subtitle "Nutritional Program
for the Elderly," to establish a nutritional program for the elderly under the
Department of Employment and Social Services and to provide the powers and
duties of that department in connection with the program.]] 5 and 6 to Article
70B of the Annotated Code of Maryland (1970 Replacement Volume and 1972
Supplement), as last amended by Executive Order No. 1 of 1973, title
"Commission on the Aging," to follow immediately after Section 4 thereof, and
to be under the new subtitle "Nutritional Program for the Elderly," to establish
a nutritional program for the elderly under the Maryland Commission on Aging
and to provide for the powers and duties of that Commission in connection with
the program.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections [[84 and 85]] 5 and 6 be and they [[are
hereby added to Article 88A of the Annotated Code of Maryland ([[1968]] 1969
Replacement Volume), title "[[State Department of Social Services 11 Social
Services Administration," to follow immediately after Section 83]] are hereby
added to Article 70B of the Annotated Code of Maryland (1970 Replacement
Volume and 1972 Supplement), as last amended by Executive Order No. 1 of
1973, title "Commission on the Aging," to follow immediately after Section 4
thereof and to be under the new subtitle "Nutritional Program for the Elderly,"
and to read as follows:
NUTRITIONAL PROGRAM FOR THE ELDERLY
[[84]] 5.
THE [[DEPARTMENT OF EMPLOYMENT AND SOCIAL SERVICES]]
MARYLAND COMMISSION ON AGING SHALL ESTABLISH AND
ADMINISTER A NUTRITIONAL PROGRAM FOR THE ELDERLY,
WHICH SHALL CONFORM TO THE PROVISIONS OF TITLE 7 OF THE
FEDERAL OLDER AMERICANS ACT OF 1965. THE [[DEPARTMENT]]
COMMISSION SHALL PRESENT THE PLAN FOR THE PROGRAM TO
THE SECRETARY OF HEALTH, EDUCATION AND WELFARE FOR
APPROVAL FOR A GRANT OF 90% OF THE TOTAL PROGRAM FUNDS
UNDER THE FEDERAL NUTRITIONAL PROGRAM FOR THE
ELDERLY. [[THE STATE SHALL PROVIDE IN THE ANNUAL BUDGET
FUNDS FOR THE PROGRAM IN ADDITION TO THOSE RECEIVED
UNDER THE FEDERAL PROGRAM.]] THE [[STATE DEPARTMENT OF
EMPLOYMENT AND SOCIAL SERVICES SHALL]] COMMISSION MAY
INCLUDE IN ITS ANNUAL BUDGET AN AMOUNT TO BE FUNDED
FROM THE GENERAL FUNDS OF THE STATE OF NOT MORE THAN
10% OF THE TOTAL PROGRAM COST, WHICH SHALL REPRESENT
THE NON-FEDERAL SHARE OF THE NUTRITION PROGRAM.

(A) THE NUTRITIONAL PROGRAM FOR THE ELDERLY SHALL
PROVIDE ELDERLY PERSONS WITH LOW COST, NUTRITIONALLY
SOUND MEALS SERVED IN CENTRALLY LOCATED FACILITIES SUCH
