CHAPTER 676
(Senate Bill 350)

AN ACT to repeal and re-enact, with amendments, Section 334 of Article 23 of
the Annotated Code of Maryland, (1966 Replacement Volume), title
"Corporations", subtitle "Condemnation of Property by Corporations", to
repeal the obsolete reference to a feme sole in the section allowing corporations,
which are authorized to condemn land, to proceed to condemn in a certain
manner if certain disabilities exist or if an agreement cannot be reached.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 334 of Article 23 of the Annotated Code of
Maryland, (1966 Replacement Volume), title "Corporations", subtitle
"Condemnation of Property by Corporations", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

334.

If any corporation incorporated under the laws of this State which shall be
authorized to acquire by condemnation any land, earth or stone, or any interest
therein, cannot agree with the owner or owners thereof, or if any of such owners be
la feme sole, and without power to contract in that regard, ] under age, non
compos mentis, or under any other legal disability to contract, or be out of the
county in which the property wanted may lie at the time the same is wanted, then
in all such cases the corporation may proceed to condemn under the provisions of
Article 33A of the Annotated Code of Maryland, title "Eminent Domain".

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 677
(Senate Bill 356)

AN ACT to repeal and re-enact, with amendments, Section 31 of Article 88B of
the Annotated Code of Maryland (1969 Replacement Volume), title "State
Police," subtitle "Pensions," to eliminate references to a particular sex in the
State Police pension law and to correct language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 31 of Article 88B of the Annotated Code of
Maryland (1969 Replacement Volume), title "State Police," subtitle "Pensions,"
be and it is hereby repealed and re-enacted, with amendments, to read as follows:

31.

(a) Whenever any of the employees of the Department of Maryland State Police,
who have elected not to become members of the State Police Retirement System
of the State of Maryland, and any of the license examiners of the Commissioner of
Motor Vehicles shall have given meritorious service as [such 1 AN employee for a
period of fifteen continuous years, and shall have reached the age of 55 years,
excepting the physician of the Department who shall have reached the age of 65
years, [such] THE employees shall be eligible for retirement forthwith upon his
