any powers which the [Department of Public Improvement) DEPARTMENT OF
GENERAL SERVICES, the (State Board of Health] DEPARTMENT OF
HEALTH AND MENTAL HYGIENE, the [Department of Geology, Mines and
Water Resources] DEPARTMENT OF NATURAL RESOURCES and the
[State Roads Commission of Maryland] DEPARTMENT OF
TRANSPORTATION now may exercise.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 675
(Senate Bill 349)

AN ACT to repeal and re-enact, with amendments, Section 333 of Article 23 of
the Annotated Code of Maryland (1966 Replacement Volume), title
"Corporations", subtitle "Water Companies", to repeal the obsolete reference
to a feme covert in the section allowing water companies to condemn land for
the purpose of laying pipes if certain disabilities exist as to the owner or owners
or if an agreement cannot be reached.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That Section 333 of Article 23 of the Annotated Code of
land (1966 Replacement Volume), title "Corporations", subtitle "Water
Companies", be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

333.

If any corporation formed for the purposes mentioned in §332 of this article
cannot agree with the owner or owners of any land or water rights which such
corporation may have power to acquire for the purpose of laying pipes or
constructing its work; or if such owner or owners or any of them, be [a feme
covert without power to contract in relation to said property, or] under age, or
non compos mentis, or under any other legal disability, or be absent from the
county or city in which the said property may lie when said land or water rights
may be needed, the corporation may proceed to condemn and acquire the same in
the manner provided for in Article 33A of the Annotated Code of Maryland, title
"Eminent Domain".

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
