(10) "Creditable Service" shall mean prior service plus membership service for
which credit is allowable as provided in Section [7] 9 of this article. In the case of
employees who enjoy such status by virtue of employment in county road systems,
as hereinbefore provided, prior service credit shall include credit for the full period
for which they have been so employed by the county involved, including service
rendered before supervision and control were assumed by the State Roads
Commission.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Sections 11(1)(a), 11(4), and
11(6) of Article 73B of the Annotated Code of Maryland (1970 Replacement
Volume and 1972 Supplement), title "Pensions," subtitle "In General;" to
repeal and re-enact, with amendments, Sections 195(l)(a), 195(3), and 195(4A)
of Article 77 of said Code (1969 Replacement Volume and 1972 Supplement),
title "Public Education," subtitle "Chapter 17. Teachers' Retirement System;"
to repeal and re-enact, with amendments, Sections 53(1)(a), 53(3), and 53(5) of
Article 88B of said Code (1969 Replacement Volume), title "State Police,"
subtitle "State Police Retirement System;" [[removing certain conditions under
which a State employee, Teacher, and State Trooper may file for retirement.]]
to change the time when, and conditions applicable to. members of the State
pension systems who file for retirement.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 11(l)(a), 11(4), and 11(6) of Article 73B of the
Annotated Code of Maryland (1970 Replacement Volume and 1972 Supplement),
title "Pensions," subtitle "In General," be and they are hereby repealed and
re-enacted, with amendments, to read as follows;

(a) Any member [in service] may retire upon written application to the board
of trustees setting forth at what time [, not less than thirty days nor more than
ninety days subsequent to the execution and filing thereof,] he desires to be retired,
provided that such member at the time so specified for his retirement shall have
attained the age of sixty (60) or shall have rendered twenty-five (25) years of
creditable service as an employee and notwithstanding that during such period of
notification he may have separated from service.
(4) Upon the application of a member [in service) or of his department head,
any member who has had five or more years of creditable service may be retired
by the board of trustees [, not less than thirty and not more than ninety days next
(following the date of filing such application, ] on an ordinary disability retirement
allowance, provided that the medical board, after a medical examination of such
member, shall certify that such member is mentally or physically incapacitated for
the further performance of duty, that such incapacity is likely to be permanent,
