or Executive official may receive benefits under more than one pension system for
the same period of service.
(9) Credit for previous service as elected or appointed official. — An employee
of the State, who is or becomes a member of the Employees' Retirement System
and who at any previous time was an elected or appointed official, (provided that
the annual compensation of such position was in excess of one thousand five
hundred dollars ($1.500.00) shall be entitled to credit for previous service rendered
by him to the State as an elected or appointed official, upon his payment of the
total cost for such period of service. ]]
(9) CREDIT FOR PREVIOUS SERVICE AS ELECTED OR APPOINTED
OFFICIAL. NOTWITHSTANDING ANY OTHER PROVISION OF
ARTICLE 73B, ANY MEMBER OF THIS RETIREMENT SYSTEM WHO
HAS PREVIOUSLY SERVED IN THE DEPARTMENT OF LEGISLATIVE
REFERENCE OR THE STATE LAW DEPARTMENT OR AS SECRETARY
OF THE SPEAKER OF THE HOUSE OF DELEGATES OR AS
SECRETARY TO THE PRESIDENT OF THE SENATE DURING A
SESSION OF THE GENERAL ASSEMBLY SHALL BE ENTITLED TO
RECEIVE CREDIT FOR SUCH SERVICE UPON PAYMENT TO THIS
RETIREMENT SYSTEM. IN A SINGLE PAYMENT, THE
CONTRIBUTION, WITH INTEREST WHICH HE WOULD HAVE PAID
ON BEHALF OF SUCH SERVICE, FOR THE PURPOSE OF THIS
SUBSECTION "YEAR OF SERVICE" SHALL MEAN A YEAR OR ANY
PORTION THEREOF.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Sections 1(8) and 1(10) of
Article 73B of the Annotated Code of Maryland (1970 Replacement Volume)
title "Pensions," subtitle "In General," to correct references in certain
definitions in the Employees' Retirement System laws.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 1(8) and 1(10) of Article 73B of said Code (1970
Replacement Volume) title "Pensions," subtitle "In General," be and they are
hereby repealed and re-enacted; with amendments, to read as follows:

(8) "Prior Service" shall mean service rendered prior to the date of
establishment of the Retirement System, or service rendered prior to membership
in the Retirement System, for which credit is allowable under Section [7] 9 of this
article.
