AN ACT to repeal and re-enact, with amendments, Section 81(d) of Article 56 of
the Annotated Code of Maryland (1972 Replacement Volume), title "Licenses,"
subtitle "Private Detectives," to require any licensee under the private detectives
laws to submit under oath to the Superintendent of the Maryland State Police
within a certain time period an annual statement which shall include a
Maryland Income Tax receipt, a certificate from an insurance carrier covering
workmen's compensation insurance, a certification that all withholding, social
security taxes, and any other required State and federal obligations have been
paid, and to provide for the assessment of a certain fee for each statement
received after a certain date.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 81(d) of Article 56 of the Annotated Code of
Maryland (1972 Replacement Volume), title "Licenses," subtitle "Private
Detectives," be and it is hereby repealed and re-enacted, with amendments, to read
as follows:
81.
(d) The holder of any license issued under the provision of this subtitle shall
submit UNDER OATH to the Superintendent an annual [report certified by the
holder to the effect] STATEMENT. THE ANNUAL STATEMENT SHALL
INCLUDE A CERTIFICATION that all withholding and social security taxes[,
workmen's compensation and any] HAVE BEEN PAID; A CERTIFICATE
FROM AN INSURANCE CARRIER SHOWING THAT WORKMEN'S
COMPENSATION INSURANCE FOR EMPLOYEES OF THE LICENSEE
IS IN EFFECT; A CERTIFICATION THAT ALL required State or federal
obligations payable for or on behalf of employees have been paid; AND A
RECEIPT FROM THE MARYLAND INCOME TAX DIVISION OF THE
COMPTROLLER'S OFFICE SHOWING THAT THE INCOME TAX OF
THE AGENCY HAS BEEN PAID. Such annual [report] STATEMENT AND
THE. RENEWAL APPLICATION FOR THE LICENSE shall be filed on or
before the fifteenth day of April in each and every year, HOWEVER, A FEE OF
TEN DOLLARS ($10.00) SHALL BE ASSESSED FOR EACH AND EVERY
STATEMENT RECEIVED BY THE SUPERINTENDENT AFTER THE
TWENTY-FIFTH DAY OF APRIL IN ANY YEAR. Should the holder of a
license not file such [report] STATEMENT AND RENEWAL APPLICATION
within the time hereinabove provided or submit a false [certificate] STATEMENT,
such omission of filing or misrepresentation shall be cause for the revocation of
such license. The Superintendent shall have access to all licensee's records referred
to in this subsection.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
