AN ACT to add new Section 10-7 to the Washington Suburban Sanitary District
Code (1969 Edition, as amended), and to add new Section 83-141A to the Code
of Public Local Laws of Prince George's County (1963 Edition, as amended),
and new Section 71-88A to the Montgomery County Code (1965 Edition, as
amended), being Articles 17 and 16, respectively, of the Code of Public Local
Laws of Maryland, title "Prince George's County" and "Montgomery County,"
both subtitled "Washington Suburban Sanitary District," to follow immediately
after Sections 10-6, 83-141 and 71-88 of the respective Codes, to require that
any road contractor doing work in public streets, roads, and ways in which the
Washington Suburban Sanitary Commission has manholes, valves, or other
water, sanitary sewerage, or storm drainage fittings, give notice to the
Commission before constructing, reconstructing, or repaving on or over the
Washington Suburban Sanitary Commission structures, with provisions for
violation of the Section.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 10-7, 83-141A and 71-88A be and they are
hereby added, respectively, to the Washington Suburban Sanitary District Code
(1969 Edition, as amended), of the Code of Public Local Laws of Prince George's
County (1963 Edition, as amended), and the Montgomery County Code (1965
Edition, as amended), being Articles 17 and 16, respectively, of the Code of Public
Local Laws of Maryland, title "Prince George's County" and "Montgomery
County," subtitle "Washington Suburban Sanitary District," to follow immediately
after Sections 10-6, 83-141 and 71-88 of the respective Codes, and all to read as
follows:

ANY ROAD CONSTRUCTION CONTRACTOR, DEFINED AS ANY
PERSON, FIRM OR CORPORATION PERFORMING OR ENGAGED OR
HIRED TO PERFORM ROAD CONSTRUCTION, REPAIR, PAVING,
REPAVING, OR GRADING, ALL OF WHICH ACTIVITIES ARE
HEREINAFTER REFERRED TO AS ROAD CONSTRUCTION WORK, IN
ANY PUBLIC HIGHWAY, STREET, ROAD, OR ALLEY WITHIN THE
WASHINGTON SUBURBAN SANITARY DISTRICT IN WHICH THE
COMMISSION HAS INSTALLED A WATER, SEWER, OR STORM
DRAINAGE STRUCTURE, PRIOR TO COMMENCING THE ROAD
CONSTRUCTION WORK, SHALL GIVE NOTICE TO THE COMMISSION
OF THE PROPOSED ROAD CONSTRUCTION WORK, WITH THE
NOTICE TO INCLUDE THE PROPOSED CONSTRUCTION SCHEDULE
WITH SPECIFICITY AS TO CONTEMPLATED CONSTRUCTION DATES
AND CONSTRUCTION LOCATION INFORMATION AS REQUIRED TO
ACCOMPLISH THE PURPOSES OF THIS SECTION. EXCEPT IN
EMERGENCY ROAD REPAIR SITUATIONS, WHEN NOTICE SHALL BE
GIVEN AS PROMPTLY AS FEASIBLE UNDER THE EMERGENCY
SITUATIONS, THE NOTICE SHALL BE GIVEN TO THE COMMISSION
