Ch. 594                          MARVIN MANDEL, Governor                             1241

(A)   ONE MEMBER OF A COUNTY FIRE DEPARTMENT AND ONE
MEMBER OF A COUNTY RESCUE SQUAD TO BE ELECTED BY THE
COUNTY VOLUNTEER FIRE AND RESCUE ASSOCIATION.

(B)     ONE MEMBER FROM EACH OF THE THREE ELECTION
DISTRICTS TO BE APPOINTED BY THE COUNTY COMMISSIONERS
FROM A LIST OF THREE (3) COUNTY RESIDENTS FROM EACH
ELECTION DISTRICT, SUBMITTED BY THE COUNTY VOLUNTEER
FIRE AND RESCUE ASSOCIATION, NONE OF WHOM SHALL BE
MEMBERS OF A COUNTY FIRE DEPARTMENT OR RESCUE SQUAD.

(C)    ONE MEMBER SHALL BE A COUNTY COMMISSIONER[[.]]
OR THEIR DESIGNEE.

(2)       THE COUNTY COMMISSIONERS ARE AUTHORIZED TO
PROVIDE THE COMMISSION, BY RESOLUTION OR ORDINANCE,
WITH WHATEVER POWERS AND DUTIES AND TO ESTABLISH
WHATEVER TERMS OF OFFICE FOR THE MEMBERS AS THEY DEEM
APPROPRIATE. HOWEVER, THE RESOLUTION OR ORDINANCE
SHALL INCLUDE THOSE POWERS AND DUTIES REQUIRED UNDER
(3), (5), AND (6) BELOW.

(3)   THE COUNTY COMMISSIONERS SHALL APPROPRIATE FUNDS
ANNUALLY IN AMOUNTS THEY CONSIDER NECESSARY FOR THE
FIRE AND RESCUE COMMISSION[[.]] , PROVIDED THAT THE
MINIMUM TOTAL AMOUNT SHALL BE NO LESS THAN ONE
HUNDRED THOUSAND_ DOLLARS ($ 100,000). THE AMOUNTS TO BE
DISTRIBUTED TO EACH FIRE AND RESCUE DEPARTMENT SHALL BE
IN ACCORDANCE WITH A BUDGET PLAN APPROVED BY THE FIRE
AND RESCUE COMMISSION. THE DISTRIBUTION OF THE FUNDS
SHALL BE MADE BY THE COUNTY COMMISSIONERS AFTER
RECEIVING THE APPROVED BUDGET PLAN FROM THE FIRE AND
RESCUE COMMISSION.

(4)     ALL PAYMENTS SHALL BE MADE NOT LESS  OFTEN THAN
SEMI-ANNUALLY AND SHALL BE ONE-HALF THE   COMMISSION
BUDGET PLAN AMOUNT AUTHORIZED TO      INDIVIDUAL
DEPARTMENTS.

(5)   THERE SHALL BE NO FIRE OR RESCUE DEPARTMENT, ANNEX
OR SUB-STATION OTHER THAN THOSE NOW HOLDING REAL
PROPERTY UNLESS THEY ARE APPROVED BY THE FIRE AND
RESCUE COMMISSION. THE COUNTY COMMISSIONERS ARE NOT
AUTHORIZED TO FUND OTHERS NOT APPROVED BY THE
COMMISSION.

(6)      BEFORE ANY NEW FIRE OR RESCUE DEPARTMENT OR
SUB-STATION TO AN EXISTING FIRE OR RESCUE DEPARTMENT
[[ARE]] IS AUTHORIZED TO OPERATE IN CALVERT COUNTY OR
RECEIVE COUNTY FUNDS, THEY MUST CONFORM TO THE
CALVERT COUNTY STANDARDS FOR FIRE AND RESCUE
DEPARTMENTS PRESCRIBED BY THE CALVERT COUNTY FIRE AND
RESCUE ASSOCIATION AND ADOPTED BY THE CALVERT COUNTY
FIRE AND RESCUE COMMISSION; PROVIDED, HOWEVER, THAT
NOTHING HEREIN IS INTERPRETED TO PRECLUDE THE LOAN OF
COUNTY FUNDS TO ANY DEPARTMENT PRIOR TO ITS MEETING
SUBJECT STANDARDS.
