to changes in organization of the executive branch, provide for the annual filing
of organizational charts by the secretaries of principal departments, define and
provide for the issuance, amendment, preservation, disposition, and publication
of executive orders and certain intradepartmental organization proposals, to
amend and clarify the laws pertaining to publication of the annual session laws
passed by the General Assembly; and to provide for special publication
procedures in 1973.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 3A of Article 41, Annotated Code of Maryland
(1971 Replacement Volume), title "Governor-Executive and Administrative
Departments," subtitle "General Provisions," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
3A.
(A)Each principal department shall be headed by a secretary [who shall be]
appointed by the Governor with the advice and consent of the Senate [and who
shall] AND [[TO serve]] SERVING at the Governor's pleasure, unless otherwise
provided by law. Each secretary shall be selected on the basis of his professional
and administrative knowledge and experience and [shall] have [such] additional
qualifications as [may be] further provided in law. He shall receive [such] THE
salary and have [such] THE assistants, employees, and professional consultants [as
may be] provided in the budget, unless otherwise provided by law, within his
assigned jurisdiction. He [shall be] IS responsible for establishing policy to be
followed by the departments, offices and other units of the State government
within the principal department. He [shall be] IS responsible for the efficient and
orderly administration of the department. He [shall be] IS responsible for the
comprehensive planning of programs and services within his jurisdiction and for
reviewing and approving the plans of all departments and other units of the State
government within his jurisdiction. He [shall be] IS responsible for the budget of
his office and for the budgets of other units of the State government within his
jurisdiction. He [shall be] IS responsible for the organization of his office and for
recommending to the Governor changes in the organization and placement of units
of the State government within his jurisdiction. He [shall have authority to] MAY
appoint officers and employees in his office as provided in the budget and [may]
review [any] THE personnel action taken by any unit[s] of the State government
within his jurisdiction. He may create [such] THE citizen advisory bodies [as] he
deems necessary for the operation of his department and shall recommend to the
Governor any modification, abolition, and transfer of advisory bodies within his
jurisdiction.
(B) ANY PROVISION OF LAW TO THE CONTRARY
NOTWITHSTANDING, A SECRETARIAL PROPOSAL, ORDER, OR
DIRECTIVE CHANGING THE ORGANIZATION, PLACEMENT, OR
NAME OF A UNIT OF STATE GOVERNMENT WITHIN THE
SECRETARY'S JURISDICTION IS NOT EFFECTIVE UNTIL APPROVED
IN WRITING BY THE GOVERNOR OR PROMULGATED BY THE
GOVERNOR AS AN EXECUTIVE ORDER.
[[(C) ON OR BEFORE THE OPENING DAY OF EACH REGULAR
SESSION OF THE GENERAL ASSEMBLY, THE SECRETARY OF EACH
PRINCIPAL DEPARTMENT OF THE EXECUTIVE BRANCH AND THE
HEAD OF EACH AGENCY OF THE EXECUTIVE BRANCH NOT
ASSIGNED TO A PRINCIPAL DEPARTMENT SHALL SUBMIT TO THE
GENERAL ASSEMBLY AN ORGANIZATIONAL CHART OF HIS
DEPARTMENT OR AGENCY. THE CHART SHALL SHOW THE MAJOR
UNITS WITHIN THE DEPARTMENT OR AGENCY AND THE NAME
