13.

Any award made under this article shall be paid in accordance with the
[provisions of § 36 and other applicable sections of Article 101 of this Code,
excluding § 66 of that article entitled "Subsequent Injury Fund."] DISCRETION
AND DECISION OF THE BOARD AS TO THE MANNER OF PAYMENT.
No award made pursuant to this article shall be subject to execution or attachment
other than for expenses resulting from the injury which is the basis for the claim.
IN EVERY CASE PROVIDING FOR COMPENSATION TO AN
EMPLOYEE OR HIS DEPENDENT UNDER THIS ARTICLE, THE BOARD
MAY, IF IN ITS OPINION THE FACTS AND CIRCUMSTANCES OF THE
CASE WARRANT IT, CONVERT THE COMPENSATION TO BE PAID IN
A PARTIAL OR TOTAL LUMP SUM, WITHOUT DISCOUNT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

(House Bill 719)

AN ACT to add new Section 9(12) to Article 73B of the Annotated Code of
Maryland (1970 Replacement Volume and 1972 Supplement), title "Pensions,"
subtitle "In General," to follow immediately after Section 9(11) thereof, to
permit a service credit for the Employees' Retirement System of certain former
employees of the Maryland Tuberculosis Association, and to generally relate
thereto.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 9(12) be and it is hereby added to Article 73B of
the Annotated Code of Maryland (1970 Replacement Volume and 1972
Supplement), title "Pensions," subtitle "In General," to follow immediately after
Section 9(11) thereof, and to read as follows:

9.

(12) NOTWITHSTANDING THE OTHER PROVISIONS OF THIS
ARTICLE, EVERY EMPLOYEE OF THE STATE WHO IS OR BECOMES A
MEMBER OF EMPLOYEES' RETIREMENT SYSTEM, WHO WAS AN
EMPLOYEE OF THE MARYLAND TUBERCULOSIS ASSOCIATION AND
WHO OPERATED ANY RADIOLOGIC EQUIPMENT UNDER THE
SUPERVISION OF THE MARYLAND HEALTH DEPARTMENT OR ITS
SUCCESSORS SHALL RECEIVE IN THE EMPLOYEES' RETIREMENT
SYSTEM SERVICE CREDIT FOR THE TIME SPENT WHILE
OPERATING ANY RADIOLOGIC EQUIPMENT FOR THE MARYLAND
TUBERCULOSIS ASSOCIATION. UPON RECEIVING A CLAIM FOR
THE SERVICE CREDIT FROM THE EMPLOYEE THE BOARD OF
TRUSTEES OF THE RETIREMENT SYSTEM SHALL VERIFY THE FACT
OF THAT PREVIOUS EMPLOYMENT, THE CONDITION OF THE
TERMINATION OF THE PREVIOUS EMPLOYMENT, AND THE
CREDITABLE SERVICE TO WHICH THE MEMBER IS ENTITLED,
COMPUTE THE AMOUNT DUE FROM THE EMPLOYEE FOR THE
SERVICE FOR WHICH CREDIT IS CLAIMED, AND SUBMIT A
