SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 540
(House Bill 454)

AN ACT to repeal Section 64 of Article 77A of the Annotated Code of Maryland
(1972 Supplement), title "Higher Education," subtitle "Scholarships," and to
enact new Section 64 in lieu thereof, to stand in the place of the section
repealed, to provide for State scholarships to children of firemen, rescue squad
members, and law enforcement officers of the State or its political subdivisions
killed in the line of duty, to provide for the manner of awarding the
scholarships, their extent, and where they may be used.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That Section 64 of Article 77A of the Annotated Code of
Maryland (1972 Supplement), title "Higher Education," subtitle "Scholarships,"
be and it is hereby repealed, and that new Section 64 be and it is hereby enacted in
lieu thereof, to read as follows:

64.

[(a) Any child between the ages of sixteen and twenty-three of any person who
was a volunteer fireman or a volunteer member of a rescue squad and who was
killed in the line of duty, if the volunteer was a resident of the State at the time he
was killed, shall receive upon application to the State Scholarship Board, State aid
for tuition, matriculation fees, boards, room rent, books and supplies for the child
attending any accredited school of higher education in Maryland.

(b)  The amount of aid granted shall not exceed five hundred dollars per year for
each applicant, and shall be paid to the institution on vouchers approved by the
State Scholarship Board.

(c)    The State Scholarship Board may adopt and promulgate rules and
regulations as reasonable and necessary for the administration of this section.]

(A) SUBJECT TO THE NEED CRITERION PROVIDED FOR IN
SUBSECTION (C), ANY CHILD BETWEEN THE AGES OF 16 AND 23 OF
ANY PERSON WHO WAS A FIREMAN, PROFESSIONAL OR
VOLUNTEER, A VOLUNTEER MEMBER OF A RESCUE SQUAD, OR A
LAW ENFORCEMENT OFFICER, OF THE STATE OR ANY OF ITS
POLITICAL SUBDIVISIONS, KILLED IN THE LINE OF DUTY, IF THE
DECEASED WAS A RESIDENT OF THE STATE AT THE TIME HE WAS
KILLED, [[SHALL]] [[MAY]] SHALL RECEIVE UPON APPLICATION
TO THE STATE SCHOLARSHIP BOARD, STATE AID FOR TUITION,
MATRICULATION FEES, BOARD, ROOM RENT, BOOKS AND
SUPPLIES FOR THE CHILD ATTENDING ANY ACCREDITED
UNDERGRADUATE SCHOOL OF HIGHER EDUCATION IN
MARYLAND.
