112                                    LAWS OF MARYLAND                              Ch. 59

EDUCATION SERVICE SHALL BE SUBJECT GENERALLY TO THE
PROVISIONS OF ARTICLE 64A OF THE CODE, TITLE "MERIT
SYSTEM."

49A. DEPUTIZING COUNTY AND MUNICIPAL EMPLOYEES TO
INSPECT EXCAVATION WORK.

THE COMMISSIONER OF LABOR AND INDUSTRY IS
EMPOWERED AND AUTHORIZED TO DEPUTIZE ANY COUNTY
AND/OR MUNICIPAL EMPLOYEE WHO IS APPROVED BY THE CHIEF
OF HIS DEPARTMENT AND WHO IS PROPERLY QUALIFIED
THROUGH A TRAINING COURSE CONDUCTED BY THE DIVISION OF
LABOR, AND INDUSTRY AND WHO HAS SUCCESSFULLY PASSED AN
EXAMINATION UPON THE SAME, TO ACT AS THE COMMISSIONER'S
AGENT IN THE INSPECTION OF EXCAVATION WORK BEING
PERFORMED WITHIN THE COUNTY OR MUNICIPAL JURISDICTION
OF THE AGENT THOSE DEPUTIZED SHALL HAVE THE SAME
AUTHORITY AS REGULARLY APPOINTED SAFETY INSPECTORS OF
THE DIVISION OF LABOR AND INDUSTRY AND SHALL REPORT ANY
AND ALL ACTIONS TAKEN TO THE COMMISSIONER OF LABOR AND
INDUSTRY ON FORMS SUPPLIED BY THE COMMISSIONER, THIS
DEPUTIZATION SHALL BE EXTENDED TO INCLUDE PROPERLY
QUALIFIED EMPLOYEES OF THE WASHINGTON SUBURBAN
SANITARY COMMISSION AND/OR OTHER SIMILAR AUTHORITIES.

SECTION 2. AND BE IT FURTHER ENACTED, That if any provision of
this Act or the application thereof to any person or circumstances shall be held
invalid, such invalidity shall not affect other provisions or applications thereof
which can be given effect without the invalid provision or application.

SECTION 3. AND BE IT FURTHER ENACTED, That all laws or parts of
laws, public general or public local, inconsistent with the provisions of this Act are
repealed to the extent of the inconsistency.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 60
(Senate Bill 148)

AN ACT to repeal and re-enact, with amendments, Section 369A(b) of Article 27
of the Annotated Code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Crimes and Punishments," subtitle "I Crimes and
Punishments," subheading "Lotteries," to exempt certain nonfranchise retail
merchants in Wicomico [[County]], Worcester, and Dorchester Counties from
the prohibition of certain games, contests, lotteries or schemes.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 369A(b) of Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title "Crimes and
Punishments," subtitle "I Crimes and Punishments," subheading "Lotteries," be
and it is hereby repealed and re-enacted, with amendments, to read as follows:
