CHAPTER 500
(Senate Bill 1222)

AN ACT to add new Section 71-10A to the Montgomery County Code (1965
Edition, as amended, being Article 16 of the Code of Public Local Laws of
Maryland), title "Montgomery County," subtitle "Chapter 71. Washington
Suburban Sanitary District," to follow immediately after Section 71-10 thereof,
and being also new Section 83-62A to the Code of Public Local Laws of Prince
George's County (1963 Edition, as amended, being Article 17 of the Code of
Public Local Laws of Maryland), title "Prince George's County," subtitle
"Washington Suburban Sanitary District," to follow immediately after Section
83-62 thereof; to provide that every application for amendment to the zoning
map of the Regional District located within Prince George's and Montgomery
Counties may be referred to the Commission for its review and comment, to
direct the Commission to review a referred application and provide written
comment thereon not later than fifteen days prior to the regularly scheduled
public hearing on the application, to require that the report contain certain
information with respect to the effect of the application upon any existing or
proposed sewer or water or other facilities under the jurisdiction of the
Commission, to require that the report include an analysis of the probable
impact upon the Commission facilities in terms of certain conditions, to require
the Commission to provide supplemental information within a specified time,
and to direct the Commission, upon request, to make available its staff and
employees to appear before the referring District Council, its designee or
hearing examiners with respect to the information required by this Section, and
generally relating thereto.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That new Section 71-10A be and it is hereby added to the
Montgomery County Code (1965 Edition, as amended, being Article 16 of the
Code of Public Local Laws of Maryland), title "Montgomery County," subtitle
"Chapter 71. Washington Suburban Sanitary District," to follow immediately after
Section 71-10 thereof; and that new Section 83-62A be and it is hereby added to
the Code of Public Local Laws of Prince George's County (1963 Edition, as
amended, being Article 17 of the Code of Public Local Laws of Maryland), title
"Prince George's County," subtitle "Washington Suburban Sanitary District," to
follow immediately after Section 83-62 thereof, all to read as follows:

71-10A(83-62A).

EVERY APPLICATION FOR AMENDMENT TO THE ZONING MAP
OF THE REGIONAL DISTRICT LOCATED WITHIN PRINCE GEORGE'S
AND MONTGOMERY COUNTIES MAY BE REFERRED BY THE
RESPECTIVE DISTRICT COUNCIL OR BY ITS DESIGNEE, INCLUDING
ANY HEARING EXAMINER APPOINTED BY THE COUNCIL, TO THE
COMMISSION FOR ITS REVIEW AND COMMENT. THE COMMISSION
SHALL REVIEW EACH APPLICATION SO REFERRED TO IT AND
COMMENT THEREON, IN WRITING, TO THE APPROPRIATE
DISTRICT COUNCIL, DESIGNEE OR HEARING EXAMINER NOT
LATER THAN FIFTEEN (15) DAYS PRIOR TO THE REGULARLY
SCHEDULED PUBLIC HEARING ON THE APPLICATION. THE
COMMISSION'S REPORT SHALL DISCUSS THE APPLICATION AS IT
WOULD AFFECT ANY EXISTING OR PROPOSED SEWER OR WATER
FACILITIES OR ANY OTHER FACILITIES UNDER THE JURISDICTION
OF THE COMMISSION. THE REPORT SHALL INCLUDE, BUT NOT BE
LIMITED TO, AN ANALYSIS OF THE PROBABLE IMPACT UPON
EXISTING AND PROPOSED SEWER OR WATER OR OTHER
