(2)  "PERSON" MEANS ANY INDIVIDUAL, FIRM, PARTNERSHIP,
PUBLIC OR PRIVATE CORPORATION, PUBLIC OR PRIVATE
INSTITUTION, PUBLIC AUTHORITY, MUNICIPAL CORPORATION,
COUNTY AND THE STATE.

(3)       "DEPARTMENT" MEANS THE DEPARTMENT OF
AGRICULTURE OF THE STATE OF MARYLAND.

(C)    IT SHALL BE UNLAWFUL FOR ANY PERSON TO FEED
GARBAGE TO SWINE, OR TO DEPOSIT OR RECEIVE SUCH GARBAGE
ON PREMISES WHERE SWINE ARE KEPT. NO SWINE HAVING BEEN
FED SUCH GARBAGE IN VIOLATION OF THIS SECTION MAY BE
SOLD OR REMOVED FROM THE PREMISES WITHIN THIRTY DAYS
OF HAVING CONSUMED SUCH GARBAGE, OR LONGER IF
PRESCRIBED BY THE DEPARTMENT, AND UNTIL THEY HAVE BEEN
APPROVED FOR REMOVAL BY THE DEPARTMENT.

(D)  THIS SECTION SHALL NOT APPLY TO PERSONS WHO FEED
GARBAGE FROM THEIR OWN HOUSEHOLD TO SWINE ON THEIR
PREMISES PROVIDED THAT NO SUCH SWINE SHALL BE SOLD OR
REMOVED FROM THE PREMISES.

(E)    THE DEPARTMENT SHALL HAVE THE AUTHORITY TO
PROMULGATE SUCH RULES AND REGULATIONS AS IT DEEMS
NECESSARY TO ADMINISTER THIS SECTION AND TO ENJOIN
VIOLATIONS OF THE SECTION AND SUCH RULES AND
REGULATIONS. THE DEPARTMENT SHALL ALSO HAVE THE
AUTHORITY THROUGH ITS AUTHORIZED AGENTS TO ENTER ANY
PREMISES FOR THE PURPOSE OF CONDUCTING REASONABLE
INSPECTIONS FOR THE PURPOSE OF ENFORCING THIS SECTION.
THE AUTHORITY PROVIDED HEREIN SHALL BE IN ADDITION TO
AND NOT IN LIMITATION OF ANY OTHER AUTHORITY OF THE
DEPARTMENT OTHERWISE PROVIDED BY LAW.

(F)  ANY PERSON THAT VIOLATES THIS SECTION OR THE RULES
AND REGULATIONS PROMULGATED THEREUNDER SHALL BE
GUILTY OF A MISDEMEANOR AND SHALL UPON CONVICTION BY A
COURT OF COMPETENT JURISDICTION BE FINED NOT MORE THAN
$500.00 AND WITHIN THE DISCRETION OF THE COURT MAY ALSO
BE IMPRISONED FOR A PERIOD NOT TO EXCEED SIX MONTHS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act His hereby
declared to be an emergency measure and necessary for the immediate preservation
of the public health and safety and having been passed by a yea and nay vote
supported by three-fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the date of its passage]]
shall take effect [[January]] July 1, 1974.
