110                                    LAWS OF MARYLAND                              Ch. 59

(2)     KEEP, MAINTAIN AND MAKE AVAILABLE TO THE
COMMISSIONER SUCH RECORDS AS MAY BE REQUIRED BY THE
COMMISSIONER UNDER THE PROVISIONS OF THIS SUBTITLE AND
FOR DEVELOPING INFORMATION REGARDING OCCUPATIONAL
ACCIDENTS, INJURIES AND ILLNESSES SO THAT PROPER
EVALUATION AND NECESSARY CORRECTIVE ACTION MAY BE
TAKEN THEREON,

(3)    DEVELOP, CONDUCT AND MAINTAIN A PROGRAM OF
SELF-INSPECTION WITHIN EACH AGENCY OF THE STATE
GOVERNMENT AND SUCH AGENCY OF EACH POLITICAL
SUBDIVISION, SAID PROGRAM TO BE APPROVED AND MONITORED
BY THE COMMISSIONER,

(4)  SHALL FILE SUCH REPORTS AS THE COMMISSIONER MAY
REQUIRE.

46.  COST OF ADMINISTRATION.

(A)  THE COST OF ADMINISTERING THE OCCUPATIONAL SAFETY
AND HEALTH PROGRAM UNDER THIS SUBTITLE SHALL BE
INCLUDED IN THE BUDGET OF THE DIVISION OF LABOR AND
INDUSTRY, TO BE PAID FROM GENERAL FUNDS, AND THE
GENERAL FUNDS OF THE STATE SHALL BE REIMBURSED BY THE
WORKMEN'S COMPENSATION COMMISSION, FROM FUNDS
RECEIVED BY THE COMMISSION PURSUANT TO THE PROVISIONS
OF SECTION 17 OF ARTICLE 101 OF THIS CODE.

(B)  THE COMMISSIONER OF LABOR AND INDUSTRY SHALL HAVE
THE POWER AND AUTHORITY TO RECEIVE AND ACCEPT GRANTS
OF MONEY FROM THE FEDERAL GOVERNMENT OR ANY AGENCY
OR AGENT THEREOF APPROPRIATED UNDER AND MADE
PURSUANT TO THE PROVISIONS AND PURPOSES OF THE ACT OF
CONGRESS KNOWN AS "OCCUPATIONAL SAFETY AND HEALTH
ACT OF 1970."

47.       APPOINTMENT OF ASSISTANT COMMISSIONER FOR
OCCUPATIONAL SAFETY AND HEALTH.

THE COMMISSIONER SHALL APPOINT AN ASSISTANT
COMMISSIONER OF LABOR AND INDUSTRY FOR OCCUPATIONAL
SAFETY AND HEALTH SUBJECT TO APPROVAL OF THE SECRETARY
OF LICENSING AND REGULATION AND MAY ASSIGN SUCH
FUNCTIONS AND DUTIES AS ARE BY THIS SUBTITLE IMPOSED ON
HIM TO SUCH ASSISTANT COMMISSIONER THAT HE DEEMS
APPROPRIATE. SAID ASSISTANT COMMISSIONER SHALL RECEIVE
SUCH SALARY AS MAY BE PROVIDED IN THE BUDGET AND SERVE
AT THE PLEASURE OF THE COMMISSIONER.

48.  APPLICABILITY OF ACT.

THE PROVISIONS OF THE SUBTITLE SHALL APPLY WITH
RESPECT TO WORKING CONDITIONS IN ALL WORK PLACES WITHIN
THE STATE OF MARYLAND EXCEPT THAT NOTHING IN THIS
SUBTITLE SHALL APPLY TO:_

(A) WORKING CONDITIONS OF EMPLOYEES OF THE FEDERAL
GOVERNMENT, AND ANY AGENCY AND INSTRUMENTALITY
THEREOF; AND
