Allegany County Ellerslie Special Tax Area certain expenditures, after certain
due formalities have been observed, may be made and to permit the
employment of an auditor.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 156(c) and (d) be and they are hereby added to
the Code of Public Local Laws of Allegany County (1963 Edition, being Article 1
of the Code of Public Local Laws of Maryland), title "Allegany County," subtitle
"Ellerslie Special Tax Area," to follow immediately after Section 156(b) thereof,
and to read as follows:
156.
(C) ANY MONEYS, FROM WHATEVER SOURCE DERIVED, HELD BY
THE CITIZENS' COMMITTEE AFTER MAKING PROVISIONS FOR
LIGHTS MAY BE EXPENDED FOR:
(1) THE CONSTRUCTION AND MAINTENANCE OF COMMUNITY
PLAYGROUNDS AND OTHER RECREATIONAL AND PLAY AREAS;
AND
(2) THE PROVISION FOR OTHER COMMUNITY PROJECTS AND
SERVICES AS NEEDED OR DESIRED BY THE CITIZENS OF THE
ELLERSLIE TAX AREA.
THE EXPENDITURE OF ANY SURPLUS FUNDS HELD BY THE
CITIZENS' COMMITTEE FOR THE SPECIAL TAX AREA SHALL BE
MADE ONLY AFTER DUE CONSIDERATION BY THE COMMITTEE
AND UPON A MAJORITY VOTE OF THE COMMITTEE.
(D) THE CITIZENS' COMMITTEE MAY EMPLOY AN ACCOUNTANT
TO AUDIT ITS BOOKS AND ACCOUNTS AND MAY ALSO EMPLOY
WHATEVER LEGAL COUNSEL IT DEEMS NECESSARY. THE
CITIZENS' COMMITTEE SHALL ALWAYS KEEP AVAILABLE AND
OPEN TO PUBLIC INSPECTION BY RESIDENTS OF THE ELLERSLIE
TAXING AREA ITS BOOKS AND ACCOUNTS.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Section 12-112(a), (b), (c) and
(d) of Article 21 of the Annotated Code of Maryland (1966 Replacement
Volume and 1972 Interim Supplement), title "Title XII. Eminent Domain,"
subtitle "Subtitle 1. General Rules," to include real estate appraisers among
those parties who are granted a right of entry after a bona fide attempt of
notification upon private property when acting on behalf of the State or any of
its instrumentalities which have the power of eminent domain.
