of performance of an obligation, but the term excludes a lessee
under a lease not intended as security;

(f)  "Operator" means the person who operates or has charge of
the navigation or use of a vessel;

(g)   "Security interest" means an interest which is reserved or
created by an agreement and which secures payment or perform-
ance of an obligation and is valid against third parties generally;

(h) "Lien holder" means a person holding a security interest;

(i) "Person" means an individual, partnership, firm, corporation,
association, or other entity.

[(j) "Commission" means the Commission on Chesapeake Bay
Affairs;]

[(k)] (j) "Department" means the Department of '[Chesapeake
Bay Affairs which is designated to issue certificates of title and cer-
tificates of number of vessels and its duly authorized representa-
tives] Natural Resources;

[(1)] (k) "Manufacturer" means any person engaged in the busi-
ness of manufacturing new and unused vessels, or new and unused
outboard motors, for the purpose of sale or trade;

[(m)] (l) "Dealer" means any person who engages wholly or in
part in the business of buying, selling or exchanging new and
unused vessels, or used vessels, or both, and/or new and unused
outboard motors or used outboard motors, or both, either outright
or on conditional sale, bailment, lease, chattel mortgage or other-
wise, and who has an established place of business for the sale,
trade and display of such vessels;

[(n)] (m) "Ship lifeboat" means a lifeboat used solely for life-
saving purposes and does not include dinghies, tenders, speedboats,
or other types of craft carried aboard a vessel and used for other
than lifesaving purposes.

[(o)] (n) "Use" means when a vessel is upon the water.

[(p)] (o) "Certificate" means any certificate of number, title,
permit, or registration issued.

2.

(a)  '[Within the limitations hereinafter set forth, the Department
of Tidewater Fisheries is the primary agency for the administration
of this article.] This article shall be administered by the Department
of Natural Resources.

(b)  [The Department of Game and Inland Fish is designated to
administer this article upon the nontidal waters of Maryland, and
is also authorized to accept any additional jurisdictional authority
which may be delegated to it by the Department of Tidewater Fish-
eries and which is granted under this article.] The following defined
words or terms, wherever they appear in this article, shall be con-
strued to mean the words or terms of the definitions thereof unless
the context requires another meaning:
