designated by the Attorney General as counsel to the Department of
Agriculture. The counsel to the Department shall have no duty other
than to render, subject to the discretion and control of the Attorney
General, such legal advice and counsel as the Secretary and other
officials of the Department may require and to supervise such other
assistant attorneys general as may be assigned to the Department.
After the Attorney General has designated the counsel to the Depart-
ment, he shall not reassign said counsel without consultation with the
Secretary of Agriculture. The Section shall not apply with respect to
any agencies or units or government within the Department of Agri-
culture to the extent that such agencies or units are authorized by
law to employ their own legal advisors or counsel.
435. Additional Powers and Duties of Secretary.
(a) The Secretary shall be responsible for the budget of his of-
fice and for the budgets of the other boards, departments, commis-
sions, offices and agencies within the jurisdiction of the Depart-
ment of Agriculture.
(b) The Secretary shall be responsible for promulgating rules
and regulations for his office. He shall review and shall have the
power to approve or disapprove or issue or revise the rules and regu-
lations of all of the offices or agencies within the jurisdiction of the
Department of Agriculture.
(c) The Secretary may, in his discretion, create such advisory
boards of such size as he deems appropriate. AND SHALL INCLUDE
AT LEAST ONE MEMBER OF THE MARYLAND AGRICUL-
TURAL COMMISSION ON EACH BOARD.
(d) The Secretary shall have a seal for purposes of authentica-
tion of copies of records or papers in his office.
(e) The Secretary shall be responsible for the coordination
and direction of all planning facilities initiated by his office. In addi-
tion, he shall keep himself fully appraised of plans, proposals and
projects of the boards, commissions, departments, offices and agen-
cies attached to or within the jurisdiction of the Department of Agri-
culture, and shall have power to approve, disapprove or modify any
plan, proposal or project of any such instrumentality.
(f) Wherever it is provided by law that an appointment to a
particular office, board, commission, department or agency within
the Department of Agriculture is to be made by the Secretary with
the approval of the Governor, and the appointee is to serve at the
pleasure of the Secretary, the Secretary shall not remove the ap-
pointee without first obtaining the approval of the Governor.
(g) In addition to the meetings of any board or commission
within the Department of Agriculture which are provided for by law
or are called by the chairman thereof, the Secretary may, whenever
he deems it appropriate, call a meeting of such boards or commissions
for the consideration of any subject which he considers necessary and
proper.
(h) All boards, commissions, departments, offices and agencies
in the Department of Agriculture shall report to the Secretary of Ag-
riculture or his designee as provided in regulations or written direc-
tives promulgated by the Secretary.
