CHAPTER 320
(House Bill 1004)

AN ACT to add new Section 121A to Article 43 of the Annotated Code
of Maryland (1971 Replacement Volume), title "Health," subtitle
"Practitioners of Medicine," to follow immediately after Section
121 thereof, to provide that the State Board of Medical Examiners
license qualified physicians free of charge of the fee it has estab-
lished for such a license if the
physicians are rendering medical
services without charge to those who could not otherwise afford
them, and if they are not engaged in the
private practice of medi-
cine, and to provide that the Board shall charge the
physician the

fee from which he is exempted if either or both of these condi-

tions change. SHALL LICENSE CERTAIN QUALIFIED PHY-
SICIANS WITHOUT FEE UNDER CERTAIN CONDITIONS.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 121A be and it is hereby added to Article 43 of
the Annotated Code of Maryland (1971 Replacement Volume), title
"Health," subtitle "Practitioners of Medicine," to follow immediately
after Section 121 thereof, and to read as follows:

121A.

(A) Any physician who is qualified to be licensed by the Board of
Medical Examiners to practice medicine in this State shall be licensed
free of charge of the fee established by the Board for such a license
if the physician meets the following conditions:

(1) He is rendering medical services without charge to those who
cannot otherwise afford these services, and

(1)    HE IS RENDERING MEDICAL SERVICES TO PA-
TIENTS, FOR WHICH HE RECEIVES NO PERSONAL REMU-
NERATION, AND

(2)    He is not in any way engaged in the private practice of
medicine.

(B) If either or both of the above conditions change, the physician
shall notify the Board which shall then charge him the fee for the
license from which he had previously been exempted pursuant to this
section.

(C)    LICENSES ISSUED PURSUANT TO THIS SECTION
SHALL BE ISSUED FOR A PERIOD OF ONE YEAR, AND MAY
BE RENEWED FOR ADDITIONAL PERIODS OF ONE YEAR.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
