CHAPTER 285
(House Bill 477)

AN ACT to repeal and re-enact, with amendments, Section 110 (a)
of Article 41 of the Annotated Code of Maryland (1971 Replace-
ment Volume), title "Governor—Executive and Administrative
Departments," subtitle "The Executive Department," subheading
"Board of Parole," to provide that the Board of Parole may consider
for parole release individuals serving concurrent sentences in a
foreign institution.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 110(a) of Article 41 of the Annotated Code of Maryland
(1971 Replacement Volume), title "Governor—Executive and Ad-
ministrative Departments," subtitle "The Executive Depart-
ment," subheading "Board of Parole," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

110.

(a) The Board shall have the exclusive power to hear cases for
parole release and revocation, and to authorize the parole of persons
sentenced under the laws of this State to any penal or correctional
institution, jail or any other place of confinement or detention therein.
The Board shall also have power to consider for parole individuals
serving sentences in
foreign institutions who were sentenced in
Maryland to a term to run concurrently with their foreign sentence;
and an individual thus
sentenced shall be considered before he is
actually paroled from the foreign institution and transferred to the
Maryland institution. THE BOARD ALSO SHALL HAVE THE
POWER TO CONSIDER FOR PAROLE AN INDIVIDUAL SERV-
ING A SENTENCE IN A FOREIGN JURISDICTION WHO WAS
SENTENCED IN MARYLAND TO A TERM TO RUN CON-
CURRENTLY WITH A FOREIGN SENTENCE. SUCH AN
INDIVIDUAL MAY BE CONSIDERED FOR PAROLE IN AB-
SENTIA AT THE TIME HE IS BEING CONSIDERED FOR
PAROLE IN THE FOREIGN INSTITUTION.
It shall also have the
power to suspend or revoke a parole upon a showing of a violation of
the conditions thereof. It shall have the further power to issue war-
rants for the return to custody of alleged violators of parole and to
suspend or revoke a parole upon a showing of a violation of the
conditions thereof.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
