806                              Laws of Maryland                      [Ch. 248

being Article 1 of the Code of Public Local Laws of Maryland),
title "Allegany County," subtitle "Fire Companies," to follow
immediately after Section 166D thereof, as added by Chapter 5
of the Acts of 1971; to be under the new subheading "LaVale
Volunteer Rescue Squad, Incorporated," to create and generally
provide for the LaVale Volunteer Rescue Squad in Allegany
County and generally relating thereto, and to provide for a local
referendum thereon.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 166E, 166F, 166G and 166H be and they are
hereby added to the Code of Public Local Laws of Allegany County
(1963 Edition, being Article 1 of the Code of Public Local Laws of
Maryland), title "Allegany County," subtitle "Fire Companies," to
follow immediately after Section 166D thereof, as added by Chapter
5 of the Acts of 1971; and all to read as follows:

LaVale Volunteer Rescue Squad, Incorporated
166E.

In addition to the LaVale Volunteer Fire Department, Inc. there
shall also be a LaVale Volunteer Rescue Squad, Inc., to be main-
tained and operated within the boundaries of the LaVale Fire Area,
as set forth in Section 163 of this article.

166F.

The County Commissioners of Allegany County are hereby author-
ized, empowered and directed to levy annually against all assessable
real property within the LaVale Fire Area a tax sufficient, but not
to exceed five cents on each $100.00 of assessable real property, to
pay the annual expenditures necessary to maintain and operate the
LaVale Volunteer Rescue Squad, Inc., its successor or successors,
including payment of encumbrances on real estate or equipment
owned by the LaVale Volunteer Rescue Squad, Inc.

166G.

The taxes levied for the coming year shall be collected by the tax
collecting authorities for this County, and every 60 days they shall
remit the whole amount of the taxes collected to the Treasurer of the
LaVale Volunteer Rescue Squad, Inc., its successor or successors, upon
the Treasurer's giving a corporate bond to this County to be ap-
proved by the County Commissioners and the County Attorney in
a penal sum to be fixed by the County Commissioners, conditioned
upon faithful discharge of the duties of the Treasurer. From the
monies so received the Treasurer of the LaVale Volunteer Fire
Squad, Inc., its successor or successors, shall pay all proper costs,
expenses, claims and demands, and such principal and interest pay-
ments on any encumbrance on real estate or equipment owned by
the LaVale Volunteer Rescue Squad, Inc., its successor or successors
as may be due, that are necessary to maintain and operate the
LaVale Volunteer Rescue Squad, Inc. Should the tax so collected in
any one year be inadequate to defray the costs, expenses, claims
and demands such deficiency may be added to the amount required
for the next year and be levied and collected in the next year's
taxes, provided that the rate shall not be in excess of that mentioned
above.
