phone, which receives the pre-recorded message, written approval
for the use of the device.
(b) Any person, firm or corporation violating the provisions of
this section is guilty of a misdemeanor and upon conviction thereof
is subject to a fine of not more than fifty dollars ($50.00) for each
offense.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

AN ACT to repeal and re-enact, with amendments, Section 90 (h)
of Article 41 of the Annotated Code of Maryland (1971 Replace-
ment Volume), title "Governor—Executive and Administrative
Departments," subtitle "1 The Executive Department," subheading
"Secretary of State," to provide that trade names shall not be
registered with the office of the Secretary of State.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 90 (h) of Article 41 of the Annotated Code of Maryland
(1971 Replacement Volume), title "Governor—Executive and Ad-
ministrative Departments," subtitle "1 The Executive Department,"
subheading "Secretary of State," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
90.
(h) The term "trade name" means a word, name, symbol, device
or any combination thereof used by a person to identify his busi-
ness, vocation or occupation and distinguish it from the business,
vocation or occupation of others. Trade names shall not be entitled
to registration under the provisions of this subheading.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
