conspicuously shown in connection with said sale or offer for sale,
and shall be shown on the container, and in the offer to sell, and
if loose, by a sign placed on or near such eggs. Any eggs not desig-
nated as Grade B or Grade C shall be presumed to be Grade A, in
allowing tolerance for quality.]
The Maryland standard for quality of individual shell eggs shall
be the same as the United States Department of Agriculture Stan-
dard of AA quality, A quality, B quality and C quality. The Mary-
land consumer grades for shell eggs shall be Grade AA, Grade A,
and Grade B except as provided in Section 166 of this subtitle.
The tolerances for Grade AA, Grade A and Grade B packed eggs
at consumer level shall be as follows:
(a) U.S. Consumer Grade AA shall consist of eggs which are 80
percent AA quality. Within the maximum tolerance of 20 percent
which may be below AA quality, not more than 5 percent may be
B quality, C quality or Checks in any combination, and not more
than 0.5 percent Leakers or Dirties in any combination.
(b) U.S. Consumer Grade Grade A shall consist of eggs which
are 80 percent A quality or better. Within the maximum tolerance
of 20 percent which may be below A quality, not more than 5 percent
may be C quality or Checks in any combination, and not more than
0.5 percent Leakers or Dirties in any combination.
(c) U.S. Consumer Grade B shall consist of eggs which are 80
percent B quality or better. Within the maximum tolerance of 20
percent which may be below B quality, not more than 10 percent may
be Checks, and not more than 0.5 percent Leakers or Dirties in any
combination.

[Two eggs in any dozen at the retail level or ten percent by count
of the eggs in a case, at the wholesale level, not having serious de-
fects, as shall be denned in the rules and regulations promulgated
hereunder, may be below the designated quality or size; but the sum
of said eggs below the designated size and quality shall not exceed
two eggs in any dozen at the retail level or ten percent by count of
the eggs in any case of eggs at the wholesale level.]
No person shall sell or offer to sell, or deliver any shell eggs not
properly designated in respect to quality and size standard, as pro-
vided for in this subtitle. Said designation shall be plainly and con-
spicuously shown in connection with said sale or offer for sale and
shall be shown on the container, and in the offer to sell, and if loose,
by a sign placed on or near such eggs. Any eggs not designated as
Grade B shall be presumed to be Grade A, in allowing tolerance for
quality.
Sec. 2. And be it further enacted, That in the event a new Depart-
ment of Agriculture administered by a Secretary of Agriculture is
created by law, the Secretary of Agriculture shall be substituted for
any reference in this Act to the State Board of Agriculture.
Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1972.
