(1971 Replacement Volume and 1971 Supplement), title "Inspec-
tions," subtitle "Eggs," be and it is hereby repealed and re-enacted,
with amendments, that Sections 161, 163 and 164 of said article,
title and subtitle be and they are hereby repealed, and that new Sec-
tions 161, 163, and 164 be and they are hereby enacted in lieu there-
of, under the same article, title, and subtitle, to follow immediately
after Sections 160, 162 and 163 thereof, respectively, and all to read
as follows:

161.

[The Maryland standard for quality of individual shell eggs shall
be the same as the United States Department of Agriculture Stan-
dards of AA quality, A quality, B quality, and C quality. The
Maryland consumer grades for shell eggs shall be Grade AA, Grade
A, Grade B, and Grade C, except as provided in Section 166 of this
subtitle. No descriptive term or terms other than the applicable
grade and size designations, shall be used when eggs are offered
for sale, exposed for sale, sold or advertised, except the descriptive
term "Fresh," and for eggs produced in Maryland, the term "Mary-
land Fresh" may be used in addition to the applicable grade and
size designation; provided further that terms "Fresh" and "Mary-
land Fresh" may not be used for eggs below A quality. Final de-
terminations as to meeting the standard of quality for shell eggs
shall be made by candling.]

The State Board of Agriculture shall have the authority to 'pro-
mulgate regulations limiting the use of term or terms other than
the applicable grade and size designations when eggs are offered
for sale, exposed for sale, sold or advertised, except the term
"Fresh," and for eggs produced in Maryland, the term "Maryland
Fresh" may be used in addition to the applicable grade and size
designation; provided further that terms "Fresh" and "Maryland
Fresh" may not be used for eggs below A quality. The standards
used for "Maryland Fresh" eggs shall be promulgated through the
rules and regulations of this law. Final determinations as to meet-
ing the standard of quality for shell eggs shall be made by candling
or other acceptable methods as determined by the State Board of
Agriculture.

162.

The size (or weight) classification for individual shell eggs in
Maryland shall be the same as official United States Department of
Agriculture Weight Classes for shell eggs for the following classi-
fications: Jumbo, Extra Large, Large, Medium, [and] Small, and
Pee Wee. [provided that shell eggs not classified as to size must be
designated as unclassified in lieu of a size classification. Weights
as permitted in this subtitle shall be net weight and shall not include
the weight of any container.] Weights as permitted in this subtitle
shall be as prescribed by rules and regulations promulgated by the
State Board of Agriculture. The net weight of eggs shall not include
the weight of any container.

163.

[No person shall sell or offer to sell, or deliver any shell eggs
not properly designated in respect to quality and size standard, as
provided for in this subtitle. Said designation shall be plainly and
