and upon conviction before any [justice of the peace of this State]
court shall be fined not less than twenty-five dollars ($25.00) nor more
than one hundred dollars ($100.00) and costs for each and every
offense[, or sentenced to jail until said fine and costs have been paid].
All fines and costs shall be paid in accordance with the provisions of
Article 38, Sec. 4.
A second conviction within the same twelve-month
period for a violation of any regulation adopted by the Commission
shall result in suspension of the violator's license for a period of
twelve months from the date of such conviction.

§ 212. Live bait dealer's license—Montgomery County.

(d) Penalties.—Any person found guilty of violating any of the
provisions of this section shall be deemed guilty of a misdemeanor
and upon conviction before any [justice of the peace of this State
or]court shall be fined not less than twenty-five dollars ($25.00) nor
more than fifty dollars ($50.00) and costs for each and every offense
[or sentenced to jail until said fine and costs have been paid]. All
fines and costs shall be paid in accordance with Article 38,
§ 4.

§ 213. Same—Frederick and Washington counties.

(d) Penalties.—Any person found guilty of violating any of the
provisions of this section shall be deemed guilty of a misdemeanor
and upon conviction before any [justice of the peace of this State or]
court shall be fined not less than twenty-five dollars ($25.00) nor
more than one hundred dollars ($100.00) and costs for each and
every offense [or sentenced to jail until said fine and costs have been
paid]. All fines and costs shall be paid in accordance with Article
38,
§ 4.

§ 214. Trespass upon land to fish in privately owned ponds pro-
hibited.

Whenever any person who owns, controls or erects an artificial
pond upon his own land, or land of which he is in legal possession,
shall put therein any fish or the eggs or spawn of fish for the purpose
of breeding and cultivating fish, and shall give notice by written or
printed handbills put up in public places near said pond, any person
who thereafter enters upon such premises, without the consent of the
owner, for the purpose of fishing or shall catch in said pond or ponds
and take therefrom any fish shall be guilty of a misdemeanor and
upon conviction thereof before any [justice of the peace in this
State] court shall be fined not less than ten dollars ($10.00) nor
more than fifty dollars ($50.00) for each and every offense [and
shall stand committed to the county jail or Baltimore City jail until
such fine and costs are paid]. All fines and costs shall be paid in ac-
cordance with Article 38,
§ 4.

§ 216. Privately owned artificial ponds or lakes.

The Department of Game and Inland Fish may issue permits au-
thorizing the establishment and operation of artificial or man-made
ponds or lakes owned, leased or controlled by an individual, associa-
tion or corporation, where fishing is permitted for payment of a fee,
and in which all fish stocked are artificially propagated by commercial
hatcheries, or purchased from persons licensed to sell fish, when
in the judgment of the Department such lakes or ponds will not con-
