632                              Laws of Maryland                      [Ch. 181

(k) Allegany County.—In Allegany County, notwithstanding any
other provisions of the section, a fee of five dollars ($5.00) shall be
paid at the time of filing any suit with any trial magistrate in the
county, which fee shall constitute the entire costs of the proceedings
for the constable and magistrate. Poundage fees as now allowed shall
be continued, and for each defendant named in any suit in excess of
two, an additional fee of one dollar and fifty cents ($1.50) shall be
added to the costs. In executing a warrant of restitution upon a land-
lords complaint, a writ of replevin or a writ of fi fa attachment upon
a judgment, the plaintiff shall be required to pay the magistrate the
costs of executing the same, said costs to be added to the judgment
entered upon the suit. The entire amount of filing fees shall be paid
over monthly to the County Commissioners by the magistrate to
whom said fees were paid.

(1) Dorchester County.—In Dorchester County, notwithstanding
any other provisions of this section, the justices of the peace shall
be entitled to receive such fees as are established by rules of court.]

§ 21. Same—In criminal cases.

[(a) Generally.—They shall be entitled to be paid in criminal cases
by the county or City of Baltimore, as the case may be, the following
fees:

For issuing each State writ............................................................ $ .25

For search warrant...........................................................................25

For taking recognizance of witnesses, each.................................25

For taking recognizances in each case reported to court.............25

For every commitment.....................................................................25

For every release...............................................................................25

For holding an inquest upon a deceased person............................ 5.00

For issuing an attachment for a witness refusing to attend on

summons of a commissioner.......................................................50

For taking depositions in cases of contested elections, per day 3.00

(b)   Cecil County.—In Cecil County the justices of the peace shall
be entitled to be paid one dollar ($1.00) for each commitment.

(c)   Calvert County.—In Calvert County, notwithstanding any
other provisions of this section, the following fees shall be paid by any
defendant who shall be found guilty and ordered as a part of his pun-
ishment to pay the costs—for each criminal warrant $4.00. In cases of
the compromise with the consent of the State's Attorney of warrants
charging assault, battery or assault and battery in lieu of the costs
above the costs for each such warrant shall be $8.00.

(d)  Allegany County.—In Allegany County, notwithstanding any
other provision of this section, any defendant who shall be found
guilty and ordered as part of his punishment, to pay the costs, shall
pay the sum of five dollars ($5.00) for each criminal warrant which
shall cover the entire costs of the case. In those cases where a warrant
which shall cover the entire costs of the case. In those cases where a
warrant charging assault, battery or assault and battery, or disorderly
conduct shall be dismissed before trial, the costs to the prosecuting
witness shall be three dollars ($3.00).
