trout stamp in addition to the regular fishing license. Said stamp
shall be obtained from any authorized agent of the Department
[of Game and Inland Fish] at a cost of $2.50 unless the applicant
is a Maryland resident who has reached his sixty-fifth birthday, in
which case the cost of a trout stamp is one dollar ($1.00).
[Residents
of the State of Maryland having attained their 70th birthday may
obtain a free trout stamp by applying to the Department of Game
and Inland Fish.] The Department may designate persons engaged
in a retail business (except where distilled spirits are sold for con-
sumption on the premises) to sell such stamps under the control
and supervision of the Department. The person selling the stamp
shall retain as compensation for issuing stamps the sum of [fifty
cents (50¢) out of each two dollars and fifty cents ($2.50) fee
charged] ten cents (10¢) for every stamp sold.

(b) It shall be illegal for any nonresident of the State, 12 years
of age or older, to fish in any of the "designated" trout streams of
the State without first obtaining a special nonresidents' trout stamp
in addition to the regular nonresidents' fishing license. Said stamp
shall be obtained from any authorized agent of the Department [of
Game and Inland Fish] at a cost of $2.50.

219.

(b) Any person having attained his sixteenth (16th) birthday
desiring to fish in the waters of the State of Maryland above a
point where the tide ebbs and flows, by means of angling or hook
and line or other implement or device shall first secure a license for
same as hereinafter provided. Such license shall entitle the holder
to fish by angling or other implement or device in said waters only
during the open season. Provided however, residents of the State
of Maryland having attained their [seventieth (70th) birthday may
obtain a free fishing license by applying to the Department of Game
and Inland Fish] sixty-fifth (65th) birthday may obtain a fishing
license upon payment of a fee of one dollar ($1.00), notwithstanding
any other provisions of this subtitle.
Said license shall be procured
from the clerk of the circuit court of any county or from the clerk
of the Court of Common Pleas of Baltimore City and in addition
thereto may be issued by such person or persons as the [Director]
Department may designate on forms prepared and supplied by the
[Director] Department in the following manner, to wit:

221.

(a) The clerks of courts or other persons authorized to sell such
license shall retain as compensation for issuing a license to either
a resident or non-resident of this State the sum of fifty cents (50¢)
if the cost of the license is five dollars ($5.00) or more, or twenty-five
cents (25¢) if the cost of the license is less than five dollars ($5.00)
and shall on the first day of each and every month transmit to the
Department [of Game and Inland Fish of the State] all moneys
received by them for licenses, and such funds shall be accounted for
by the said Department to the Treasurer. The amount so received
by the Treasurer shall be placed to the credit of a separate fund
known as the "State Game Protection Fund" and shall be paid by
the Treasurer on warrant of the Comptroller upon requisition of
the Department [of Game and Inland Fish]. The moneys in said
fund to the credit of the angler's license shall be used solely for the
