(ix) Any insured under the plan as of January 1, 1970 who has
completed any three year assignment period, and who during that
period has had no moving traffic violations, except one point, or
traffic accidents for which he or any authorized operator was held
responsible, is entitled to renewal coverage from the assigned insurer
at rates comparable to those charged by standard insurers and
approved by the Commissioner. It is the responsibility of the as-
signed insurer to notify the insured that the company will provide
renewal coverage on this basis. The renewal coverage provided for
in this section will continue on a year to year basis.]
16A. Maryland Automobile Insurance Fund
243. Creation and organization.
(a) There is created a body politic and corporate known as the
Maryland Automobile Insurance Fund, hereinafter referred to as
"the Fund". The Fund shall consist of the revenues, premiums, and
other receipts provided for in this subtitle.
(b) Executive Director. The Executive Director of the Fund shall
be the administrative head of the Fund and shall be responsible for
the exercise of all powers and duties conferred upon the Fund by
this subtitle, except for and subject to those powers and duties con-
ferred upon the Board of Trustees. The Executive Director shall be
appointed by the Governor and shall serve at the pleasure of the
Governor. His compensation shall be determined by the Board of
Trustees, with the approval of the Governor.
(c) Board of Trustees. The Board of Trustees of the Fund shall
consist of three persons, one of whom shall be ex officio the Motor
Vehicle Administrator and who shall be Chairman of the Board. The
other two trustees shall be appointed by the Governor and shall serve
at the pleasure of the Governor. The Board of Trustees shall advise
the Executive Director with respect to his exercise of the powers and
duties conferred on him by this subtitle. Each trustee who is not
otherwise an officer or employee of the State shall receive per diem
compensation set by the Board of Public Works for each day actually
engaged in the discharge of his official duties as a trustee, and each
trustee shall receive reimbursement for all necessary and proper
expenses.
(d) Staff. The Executive Director shall appoint and remove the
staff of the Fund in accordance with the provisions of Article 64A
of the Annotated Code of Maryland. Except for such positions as may
be designated by the Executive Director, with the approval of the
Board of Trustees, as technical or professional positions, the staff
shall be classified employees. The compensation of unclassified per-
sonnel shall be determined by the Board of Trustees with the approval
of the State Secretary of Personnel.
243A. Revenues and Operating Expenses.
(a) On January 1, 1973, there shall be transferred and assigned
to the credit of the Fund all of the assets of every type and descrip-
tion held by or for the benefit of the Unsatisfied Claim and Judgment
Fund as of the close of business on December 31, 1972, except such
items of furniture and equipment the Executive Director deems to be
unnecessary, which items shall be turned over to the Secretary of
General Services.
