Section 563. Department of Recreation and Parks, established. There
shall be a Department of Recreation and Parks under the immediate direc-
tion of a Director of Recreation and Parks who shall perform such duties
and conduct such work as the Administrative Director may require. It
shall be the responsibility of said Department to promote recreation for
the children, youths and adults of Wicomico County. The Department of
Recreation and Parks shall perform such duties and functions relating to
the formulation of plans and policies for public recreation, the organiza-
tion of recreation councils and the establishment of recreation programs
as, prior to the adoption of this Public Local Law, were performed by the
War Memorial Recreation Commission, subject, nevertheless, to all pro-
visions of the Charter of Wicomico County and the Public Local Laws
thereof.
Section 2. AND BE IT FURTHER ENACTED, that there shall be a
Wicomico County Recreation Commission consisting of not more than fif-
teen (15) members to be appointed by the County Council of Wicomico
County, one-third (⅓) of whom shall be appointed for an initial term
of one (1) year, one-third (⅓) of whom shall be appointed for an initial
term of two (2) years, and one-third (⅓) of whom shall be appointed
for an initial term of three (3) years. The terms of members thereafter
shall be for three (3) years. Each member shall be eligible for appoint-
ment to a maximum of two (2) consecutive three (3) year terms. Unless
and until otherwise provided by legislative act of the County Council, the
Wicomico County Recreation Commission shall have and perform such
duties and functions relating to advice as to the formulation of plans and
policies for public recreation, the establishment of recreation programs
and the creation of recreation policies as were, prior to the adoption of
this legislative act, performed by the War Memorial Recreation Commis-
sion, subject, nevertheless, to all provisions of the Charter of Wicomico
County and the Public Local Laws thereof.
Section 3. AND BE IT FURTHER ENACTED, that this Act, having
been passed by the County Council of Wicomico County at its Legislative
Session of February, 1971, shall take effect July 1, 1971, unless a proper
petition for referendum thereof shall be validly filed prior to said date,
in which event this act shall not take effect until the expiration of thirty
(30) days following approval of this Act by a majority of the qualified
voters of the County voting in any such referendum.
