2882                            County Local Laws

2.    The applicant has had at least two season's experience as a
lifeguard or operator. The successful completion of the training
course given by the Swimming Pool Operator's Training Association
of the Washington Metropolitan area or an approved equivalent
course may be substituted for one season's experience.

3.    The applicant has successfully passed an examination given
by the approving authority. Any person who held an operator's
license issued by Montgomery County for the previous operating
season shall not foe required to take a reexamination.

(f) A swimming pool operator's license shall be valid until
revoked or until the date one year from the date of issuance. Such
license may be revoked by the approving authority for cause, in-
cluding obtaining a license by fraud.

105-9. Safety standards.

All private and public swimming pools shall be equipped with
life saving and emergency equipment which permits the retrieval of
persons from the pool without the necessity of having to enter the
water. There shall be an operable telephone on the premises on
which the pool is located.

105-10. Fees.

The fee for obtaining a public swimming pool operator's license
shall be five dollars per year or such amount as the County Executive
by regulation may set from time to time. An additional charge of five
dollars will be made to an applicant for administration of the examina-
tion by the approving authority as provided in this Chapter. The fee
for obtaining a permit for a public swimming pool shall be twenty-
five dollars per year per pool exclusive of wading and spray pools or
such amount as the County Executive, by regulation, may set from
time to time. Fees shall not exceed the reasonable costs of adminis-
tering and enforcing this Chapter. There shall be no operating permit
fee charged for any pool operated by Montgomery County.

Article II. Fencing.

105-11. Enclosure of Swimming Pool.

Every outdoor private pool, including any artificial body of water
or structure, basin, chamber or tank, either above or below ground,
over eighteen inches deep at any one point, having a capacity for a
minimum depth of eighteen inches, which has been dammed up, pro-
duced or made by human labor and skill and which is used or intended
to be used for swimming, wading, diving or water play, shall be
completely surrounded or the property upon which such pool is
situated shall be completely surrounded by an approved fence or wall
not less than forty-two inches in height, which shall be securely
anchored in the ground, and which shall be of such specification and
