(d)    To maintain the cleanliness of decks, surfaces, bath houses
and other associated facilities;

(e)    To assure performance of equipment and fixtures in the
manner for which they were intended;

(f)    To provide for the personal hygiene of the bathers; and

(g)    All permittees and licensees shall follow material and
methods specifications, inspection procedures and maintain such re-
cords of operation as provided by the State Department of Health
and Mental Hygiene regulations and further set forth in the Manual
on Public Swimming Pool Operations as such manual may be issued
by the County Executive.

105-8. Personnel standards—Lifeguards and Operator.

(a)    Every public swimming pool shall be in the immediate
control of an operator in possession of a valid swimming pool operator's
license from the approving authority.

(b)    It shall be unlawful for any person to operate or conduct
a public swimming pool unless at least one lifeguard is present on
deck when the public swimming pool is open for use. The approving
authority may require additional lifeguards to be on deck at any
public swimming pool, upon a finding that the pool is inadequately
guarded due to:

1.    The number of bathers using the pool, or

2.    Shape, dimensions and layout of the pool, or

3.    The existence of obstructions to vision, or

4.    Capabilities of the bathers using the pool.

(c)    A person may fulfill the function of both lifeguard and oper-
ator, when such duplication can be accomplished without adversely
affecting the safety and operational standards. In acting as a life-
guard, such person shall be on deck and observing the pool whenever
any person is in the water and shall not leave such post for operating
or other reasons without ascertaining that all persons are out of the
water.

(d)    Any person desiring to obtain a swimming pool operator's
license shall apply to the approving authority on forms provided by
it. Such application shall be accompanied by the fee as hereinafter
provided and evidence of age and qualifications.

(e)    The approving authority shall issue a swimming pool
operator's license upon finding to its satisfaction that:

1. The applicant is 18 years of age or older unless this require-
ment is specifically waived by the approving authority upon proof of
maturity, judgment, and responsibility to perform.
