2.7 Notice.
It shall be the responsibility of the Council Staff Director to
notify members of the Council, and to make available to the general
public through the news media, and furnish upon individual request
of members of the public, information as to the time and purpose
of all regularly scheduled and special meetings and sessions, as well
as known items of agenda and matters pending before the Council.
Sec. 3. Subsection 16.1 of Section 16 of Chapter 1A of the
Montgomery County Code 1965, as amended, is hereby repealed and
re-enacted, with amendments, to read as follows:
Section 16. APPOINTMENTS; CONFIRMATION OF APPOINT-
MENTS.
16.1 Career Appointments; Council Staff Director; Secretary and
Employees.
The County Council shall establish in accordance with the Per-
sonnel Regulations, subject to the budget, appropriate grades for
the Council Staff Director, the Secretary and other employees of the
Council. Whenever there is a vacancy existing in the County Council
Staff, the President of the Council, or such other persons or members
as the County Council may direct, shall interview applicants qualified
for such position and shall make recommendation to the full Council.
Appointment of the Council Staff Director and the Secretary shall be
by resolution on the affirmative vote of a majority of Council mem-
bers in office, and the Council Staff Director and the Secretary shall
be career positions under the Merit System, subject to removal by
the Council in accordance with the Personnel Regulations. Other em-
ployees of the Council, except employees of the Hearing Examiner,
shall be appointed by the Council Staff Director with the approval
of the Council and shall be career merit system employees. Employees
of the Hearing Examiner shall be appointed by the Administrative
Hearing Examiner and shall be career merit system employees. Noth-
ing herein shall be construed to permit or require the appointment of
a Hearing Examiner by any person or body other than the County
Council sitting as a District Council.
Sec. 4. Severability.
The provisions of this Act are severable and if any provision,
sentence, clause, section or part thereof is held illegal, invalid or
unconstitutional or inapplicable to any person or circumstances, such
illegality, invalidity or unconstitutionality, or inapplicability shall not
affect or impair any of the remaining provisions, sentences, clauses,
sections or parts of the Act or their application to other persons
or circumstances. It is hereby declared to be the legislative intent
that this Act would have been adopted if such illegal, invalid or
unconstitutional provision, sentence, clause, section or part had not
