COMMERCIAL ENTERPRISE shall mean any establishment, the
primary function of which is the sale of any product or commodity.

COMMERCIAL KENNEL shall include any animal boarding
place or other establishment for the commercial breeding of dogs and/
or cats, or the boarding, grooming, sale or training of dogs and/or
cats for which a fee is charged; provided that, animal hospitals
maintained by a licensed veterinarian as part of the practice of
veterinary medicine for the treatment of animals and dog fanciers'
kennels shall not be considered "Commercial Kennels."

DOG FANCIER shall mean any person who owns or keeps,
within or adjoining a private residence, three or more dogs for the
noncommercial purposes of hunting, practice tracking, or exhibition
in dog shows or field or obedience trials.

DOG FANCIER'S KENNEL shall mean an establishment main-
tained by a dog fancier within or adjoining a private residence for
the maintenance or training of the dogs owned or kept by such
dog fancier.

HEALTHFUL—A condition, appropriate to the particular
species of animal involved, which is hygienic and conducive to the
maintenance of the animals' well-being and to the prevention of
disease.

KEEPER refers to any individual, association or corporation or
employee thereof maintaining any facility regulated by this Chapter.

PET SHOPS—Any establishment maintained separately or in
connection with another commercial enterprise which offers to sell
any species of live animals, with the intent that they be kept as pets.

RODENT PROOF is a state or condition not conducive to the
entry, feeding, harboring or breeding of rodents.

SANITARY means a condition of good order and cleanliness
which precludes the probability of disease transmission.

VENTILATION—All rooms in which animals are displayed or
confined shall either be connected to an outside ventilating system or
some other appropriate means of ventilation and air filtration shall
be provided.

Sec. 2. New Section 76-53A, title "Commercial Breeding," is
hereby added to Chapter 76, title "Animals and Fowl," of the Mont-
gomery County Code 1965, as amended, to follow immediately after
Section 76-53 thereof and to read as follows:

76-53A. Commercial Breeding.

The harboring of three or more male dogs or cats each of which
is used primarily for stud for which a fee is charged and/or the
