fee, issuance."; by repealing and re-enacting, with amend-
ments, Section 76-60, title "Same—Denial, revocation or
suspension—Generally," subsection (b) and existing subsection
(d) and by adding a new subsection (d) and redesignating
existing subsections (d), (e), (f), (g), (h), (i), (j) and (k) of
Section 76-62, title "Minimum standards for the housing and care
of animals," and by repealing and re-enacting with amendments
subsections (a) and (d) of Section 76-63, title "Same—Special
provisions as to dogs and cats," and by adding a new subsection
(f) to said Section 76-63 to define and provide generally for the
licensing and regulation of dog fanciers and dog fanciers' kennels,
to provide standards for the care and treatment of animals at
such kennels, to distinguish such kennels from commercial kennels
and to provide a prima facie distinction between commercial and
non-commercial breeding, to revise the definition of commercial
kennel to exempt animal hospitals which treat animals therefrom,
to provide that sick animals be separated from other animals, to
define compartments and generally clarify the standards for the
care and treatment of animals at licensed establishments.

Be It Enacted by the County Council for Montgomery County,
Maryland,
that—

Sec. 1. The title of Article III and Section 76-53 of Chapter
76, title "Animals and Fowl," of the Montgomrey County Code 1965,
as amended, are hereby repealed and re-enacted, with amendments, to
read as follows:

Pet Shops and Kennels
Division I—Generally
76-53. Definitions.

For the purpose of this Article the words and phrases herein
listed shall be defined as follows:

ANIMALS shall mean every species of animals and shall include
fowls, birds, fish, turtles and rodents. It shall include, for the purpose
of defining a pet shop or commercial kennel, any living creature sold
or exchanged as a commercial item.

CAGES shall include any interior enclosure of limited space
enclosed on the bottom and on all four sides by either solid walls or
otherwise in which animals or other creatures are placed for purposes
of confinement or display. No cage shall be enclosed entirely by
solid walls.

COMPARTMENTS shall mean an enclosure of limited space
enclosed on the bottom and all four sides by either solid walls or
otherwise and constructed in the same manner as a cage but with
access into an enclosed exercise area.
