with amendments, subsection (a) of Section 96-5, titled "Super-
intendent of police generally," to provide that the Superintendent
be directly responsible to the Director of the Department of Po-
lice; and to amend Chapter 109, titled "Weapons," of the Mont-
gomery County Code 1965, as amended, by repealing and re-
enacting, with amendments, Section 109-3, titled "Range approval
committee established; powers, duties and functions," to provide
that the Range Approval Committee be appointed by the County
Executive subject to the confirmation of the Council.
Be It Enacted by the County Council for Montgomery County,
Maryland, that—
Sec. 1. Subsection (a) of Section 96-5, Chapter 96, titled
"Police," of the Montgomery County Code 1965, as amended, is hereby
repealed and re-enacted, with amendments to read as follows:
96-5. Superintendent of Police generally.
(a) Generally. The Superintendent of Police is the chief
executive officer of the Division of Police Protection and in the exer-
cise of his duties he shall be subject to such orders, rules and regula-
tions as may be issued by the County Executive from time to time
and he shall be responsible to the Director of the Department of
Police for the proper and efficient conduct, control and discipline of
the Division of Police Protection.
Sec. 2. Section 109-3, Chapter 109, titled "Weapons," of the
Montgomery County Code 1965, as amended, is hereby repealed and
re-enacted, with amendments, to read as follows:
109-3. Range Approval Committee established; powers, duties and
functions.
There is hereby established a Range Approval Committee for
Montgomery County to be composed of seven members who shall be
appointed by the County Executive subject to the confirmation of the
Council. Members of the Range Approval Committee shall serve for
a term of three (3) years. The County Executive shall designate
one member of the Range Approval Committee to serve as Chair-
man. One ex officio member shall be an employee of the Division of
Police Protection. The Committee shall issue target, trap and skeet
range and shooting area approval certificates, which certificates may
specify the type of gun or ammunition which may be used on such
range or area. Any such approval certificate shall be valid for eighteen
months after its issuance, and shall be issued only upon a finding
by a majority of the Committee that the discharge of guns upon
such ranges or area will not jeopardize life or property. No range
or area shooting certificate shall be issued except upon the written
application of the owner, lessee or person lawfully in possession of the
