illegality, invalidity or unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions, sentences,
clauses, sections or parts of the Act or their application to other
persons or circumstances. It is hereby declared to be the legislative
intent that this Act would have been adopted if such illegal, invalid
or unconstitutional provision, sentence, clause, section or part had
not been included therein, and if the person or circumstances to which
the Act or any part thereof is inapplicable had been specifically
exempted therefrom.
Sec. 5. Effective date.
This Act shall take effect on December 7, 1970.

AN ACT to repeal and re-enact, with amendments, Section 2-83,
title "Fire Board," of Article XIII, title "Advisory Boards,"
Montgomery County Code 1965, to provide for approval of the
Chairman of the Fire Board by the County Executive, subject to
confirmation by the County Council; to provide for County ap-
proval, in accordance with Sections 2-137 and 27-2 of the Code,
of locations for fire and rescue stations; to require the Fire
Board to furnish semi-annual reports to the County Executive
and Council; to provide for final approval of budgets under
Council budget procedures; to require treasurers of individual
fire departments and rescue squads to report expenditures to the
County; to delete an obsolete provision relating to Fire Tax
District study and to redesignate subsections in a manner con-
sistent with other sections of the Code.
Be It Enacted by the County Council for Montgomery County,
Maryland, that—
Sec. 1. Section 2-83, title "Fire Board," of Article XIII, title
"Advisory Boards," is hereby repealed and re-enacted, with amend-
ments, to read as follows:
2-83. Fire Board.
a. Fire Board Established and Membership.
There is hereby established a Montgomery County Fire Board,
to be composed of the chief of each fire department and rescue squad
within the County, including the chief of the fire department of the
City of Takoma Park, Maryland, and one elected delegate from each
fire department and each rescue squad, said delegate to be elected
annually in June from among the membership of the respective de-
