Sec. 7. Section 22-42, Chapter 22, titled "Sewers, Sewage Dis-
posal and Drainage," of the Montgomery County Code 1965, is
hereby repealed and re-enacted, with amendments, to read as follows:
22-42. Hearing prior to creation of district by law.
Before the creation of a storm district or subdistricts, the Council
shall hold a public hearing as provided by law. The Council further is
authorized, at its discretion, to give such other notice as the Council
shall deem necessary. If financing of the project is to be by benefit
assessment, each property owner subject to assessment shall be
mailed, to his address as listed in the assessment record of the De-
partment of Finance, a copy of the proposed legislation showing
thereon the amount estimated to be assessable against his property,
with notice of the time and place of the hearing.
SEC. 8. Section 22-44, titled "Creation by public local law," of
Chapter 22, titled "Sewers, Sewage Disposal and Drainage," of the
Montgomery County Code 1965, is hereby repealed in its entirety.
Sec. 9. Severability.
The provisions of this Act are severable and if any provision,
sentence, clause, section or part thereof is held illegal, invalid or un-
constitutional or inapplicable to any person or circumstances, such
illegality, invalidity or unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions, sentences,
clauses, sections or parts of the Act or their application to other
persons or circumstances. It is hereby declared to be the legislative
intent that this Act would have been adopted if such illegal, invalid or
unconstitutional provision, sentence, clause, section or part had not
been included therein, and if the person or circumstances to which the
Act or any part thereof is inapplicable had been specifically exempted
therefrom.
Sec. 10. Effective date.
This Act shall take effect on December 7, 1970.

AN ACT to repeal in its entirety Section 2-11, title "Same—Pocket
supplement to code," of Chapter 2, title "Administration" of the
Montgomery County Code 1965 to eliminate the necessity of a
Council resolution authorizing the publication of a cumulative
supplement to the Montgomery County Code.
