2762 County Local Laws
Sec. 3. Section 22-38, Chapter 22, titled "Sewers, Sewage Dis-
posal and Drainage," of the Montgomery County Code 1965, is hereby
repealed and re-enacted, with amendments, to read as follows:
22-38. Law creating district to specify boundaries, scope of work
and costs.
As to each district or subdistrict created under this Article, the
law shall designate the boundaries of such area and shall describe
generally that part of the drainage system within such area proposed
to be improved. The law shall contain a statement of the estimated
cost of such construction, and an estimate of the annual cost of re-
pairing and efficiently maintaining the facilities therein after initial
construction.
Sec. 4. Section 22-39, Chapter 22, titled "Sewers, Sewage Dis-
posal and Drainage," of the Montgomery County Code 1965, is
hereby repealed and re-enacted, with amendments, to read as follows:
22-39. Financing generally.
The law shall provide for a method of financing the construction
of the facilities within such district or subdistrict. The method of
financing may be by the issuance of bonds or by annual appropriations
of operating funds available for drainage purposes as specified in the
annual appropriation resolution of the County Council. Funds neces-
sary for such facilities and the maintenance thereof may be obtained
by the levy of a uniform ad valorem tax on all real property and
tangible personal property now or hereafter taxable by law within
such district or subdistrict or, in the alternative, the Council may
provide that the cost of such facilities and the annual maintenance
cost thereof be financed by a square foot benefit assessment, a front
foot benefit assessment, or other type of special assessment on all
real property within such district or subdistrict which it expects to
be benefited by the construction. If a special benefit assessment is
proposed, the law shall provide for the assessment on real property
within the district and the method of payment, which method may be
by equal annual installments over a period up to twenty years, and
any additional annual assessment which is estimated to be required
for the yearly repair and maintenance of the facilities.
Sec. 5. Section 22-40, Chapter 22, titled "Sewers, Sewage Dis-
posal and Drainage," of the Montgomery County Code 1965, is hereby
repealed and re-enacted, with amendments, to read as follows:
22-40. Contracts, cost sharing, etc.
In planning for the purpose of this Article, the County Executive
shall have full power and authority to negotiate any and all appropri-
ate contracts or agreements with the Washington Suburban Sanitary
Commission, the government of the District of Columbia, and with
