sons or circumstances. It is hereby declared to be the legislative
intent that this Act would have been adopted if such illegal, invalid
or unconstitutional provision, sentence, clause, section or part had
not been included therein, and if the person or circumstances to
which the Act or any part thereof is inapplicable had been specifically
exempted therefrom.
Sec. 51. Effective date.
This Act shall take effect on December 7, 1970.
CHAPTER 4
(BILL NO. 26-70)
AN ACT to amend Chapter 84, title "Finance and Taxation," of the
Montgomery County Code 1965, by repealing and re-enacting
with amendments, Section 84-4, title "Settlement of claims by
County Attorney," to authorize the County Attorney to settle
claims by and against the County with the approval of the
County Executive.
Be It Enacted by the County Council for Montgomery County,
Maryland, that—
Sec. 1. Section 84-4, Chapter 84, title "Finance and Taxation,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
84-4. Settlement of claims by County Attorney.
(a) On behalf of the County, the County Attorney is hereby
authorized to effect a settlement of all claims by or against the County
and all court cases to which the County is a party where the amount of
the claim or the amount involved in the suit is not more than one
thousand dollars ($1,000.00) and in his judgment it is proper and
advisable to do so. The County Attorney is further authorized to
effect, with the approval of the County Executive, a settlement of all
other claims by or against the County and all other court cases to
which the County is a party, when in his judgment and that of the
County Executive it is advisable and proper to do so. In court cases
in which the members of the County Council are parties in their
capacity as such, the County Attorney is hereby authorized to effect
settlement on their behalf upon the approval of the Council, except in
cases where each member of the Council may be personally liable or
responsible, in which cases settlement shall be made only on behalf of
each member approving such settlement.
(b) The authority granted by this Section shall apply to all
future and past settlement.
Sec. 2. This Act shall take effect on December 7, 1970.
