24-55. Filing fee to accompany application.

Except for applications by the County and other governmental
agencies, no application under this Article shall be received for filing
unless it is accompanied by the payment of a filing fee in the amount
of fifty dollars, or such other amount established by regulation of the
County Executive, from time to time, to defray the cost of hearing
and other expenses of such application.

Sec. 37. Subsection (a) of Section 24-56, Chapter 24, title
"Streets and Roads," of the Montgomery County Code 1965, as
amended, is hereby repealed and re-enacted, with amendments, to
read as follows:

24-56. Freeways and Expressways—Authority to establish, etc.;
evidence of freeway or expressway; requiring public hearing
in certain cases and defining freeways and expressways.

(a) The County may lay out, establish and construct any
existing or proposed County road as a freeway or expressway. The
County Executive may, by written regulation, designate that a pro-
posed highway is to be constructed as a freeway or expressway. Such
regulation shall be conclusive evidence that the road, when con-
structed, is a freeway or expressway with all the characteristics and
incidents prescribed by this and the following five Sections.

Sec. 38. Subsection (a) of Section 24-57, Chapter 24, title
"Streets and Roads," of the Montgomery County Code 1965, as
amended, is hereby repealed and re-enacted, with amendments, to
read as follows:

24-57. Same—Authority to designate; existing and new means of
ingress and egress.

(a) The County may designate as a freeway or expressway
all or any portion of any County road theretofore laid out, adopted,
established and constructed, subject to the applicable provisions of
Section 24-56 of this Chapter.

Sec. 39. Section 24-62, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:

24-62. Same—Adoption of rules and regulations.

The County Executive is authorized to adopt necessary rules or
regulations concerning freeways or expressways; such may include,
but not be limited to, further provisions for the establishment, con-
struction, use and access to freeways or expressways.

Sec. 40. Section 103, title "Procedure, etc., upon construction
of streets for developing companies," of Chapter 103, title "Streets
and Roads," is hereby repealed in its entirety.
