the road or right-of-way is no longer necessary for present or antici-
pated future public use. No road or right-of-way which is the sole
means of ingress and egress to any property may be abandoned and
closed.

Sec. 30. Section 24-48, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its en-
tirety and a new Section 24-48 is hereby added in lieu thereof to
read as follows :

24-48. Appeal from action of the Council.

The action of the Council on any application for abandonment
or closing shall be final; except that within thirty days after the
date action is taken by the Council, any person aggrieved thereby
may appeal to the Circuit Court.

SBC. 31. Section 24-49, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.

SEC. 32. Section 24-50, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.

SEC. 33. Section 24-51, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.

SEC. 34. Section 24-52, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:

24-52. When abandonment or closing to become effective.

No abandonment or closing pursuant to the provisions of this
Article shall become effective unless the applicant within sixty days
of the adoption of the resolution of the Council providing for such
abandonment or closing shall cause to be recorded among the land
records of the County, in due form for recording, a record showing
such abandonment or closing. The County Executive shall, upon de-
mand, execute such document or record as may be necessary to carry
out the provisions of this Article.

SEC. 35. Section 24-54, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.

Sec. 36. Section 24-55, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
