said city, town, village or special taxing area relating to the construc-
tion of roads or public ways and assessment therefor.
Sec. 22. Section 24-39, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
24-39. Payment of Assessments.
Assessments shall be due and payable upon adoption of the reso-
lution making the same; provided, that the Council may provide in
such resolution that such assessments may be paid in not more than
twenty equal installments. All assessments shall bear interest from
the date of such resolution, except as provided in this Article, at the
rate of interest per annum which shall be the interest rate paid by
the County on its bonds used for the purpose of capital construction
of the road plus one percent. When such resolution is adopted between
July 1 and December 31 of any year, it shall provide that the first
installment shall be due and payable immediately upon such adoption.
When adopted between January 1 and July 1 of any year, it shall
provide that the first installment shall be due and payable on such
first day of July. Each subsequent installment shall be paid an-
nually on July 1 of each year thereafter until the entire amount
is paid. Upon the payment of each installment, including the first,
interest shall be paid on the unpaid balance of the assessment
computed to the due date of the installment; provided, that no
interest shall be charged upon any amount paid within three
months after the assessment is made; and, provided further, that if
any installment together with the interest thereon is not paid on or
before October 1, following its due date, there shall be charged a
penalty of one-half of one percent on such installment and interest
or such other higher rate as may be computed by the Director of
Finance as necessary to equal the cost to the County of such late
payment for each month thereafter that the same remains unpaid.
Sec. 23. Section 24-41, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
24-41. Correction of errors in assessments.
Whenever through error, inadvertence or oversight, any prop-
erty subject to assessment has not been properly assessed, or such
assessment erroneously describes the property or is made in a wrong
name or in an erroneous amount, or where service upon the property
owner has not been made, the Council may, upon the recommenda-
tion of the County Executive or upon its own discovery of such error,
inadvertence or oversight, correct the assessment by amendment of
the resolution making the same without further notice to the property
owner affected thereby; provided, that such property owner had notice
