Sec. 18. Section 24-35, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.
SEC. 19. Section 24-36, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its
entirety.
Sec. 20. Section 24-37, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
24-37. Same—Assessment of corner lots.
In all cases where the property to be assessed for construction is
located at the intersection of two or more streets and is what is known
as a corner lot, the linear frontage of such corner lot to be assessed in
connection with the construction of each street adjacent thereto shall
be reduced to one-half of the total frontage of such lot upon the
street which it is proposed to construct, but such reduction shall not
exceed fifty feet on any one street. The portion of the cost of the
construction which would otherwise have been assessed to such corner
lots shall be added to the overall cost assessed to the remaining assess-
able frontage of the whole project, or may be paid for in whole or in
part by the County.
Sec. 21. Subsection (a) of Section 24-38, Chapter 24, title
"Streets and Roads," of the Montgomery County Code 1965, is hereby
amended to read as follows:
24-38. Roads partly in unincorporated area and partly in city, town,
etc.
(a) Whenever a road lies partly within the unincorporated
area of Montgomery County and partly within a city, town, village
or special taxing area therein which has jurisdiction over the con-
struction or maintenance of that part of the road lying within such
incorporated area, the entire length and width of such road may be
constructed by the County or by the city, town, village or special
taxing area in accordance with the laws, ordinances, rules and regula-
tions relating to the construction of County roads, or "public ways"
of such city, town, village or special taxing area, as defined in the
Annotated Code of Maryland, 1957, Article 23B, Section 74, in the
same manner as if such road lay wholly within the unincorporated
area of the County or wholly within such city, town, village or special
taxing area; provided, however, that the County Executive of the
County or the governing body of such city, County, village or special
taxing area shall consent thereto to the other of such parties desiring
so to construct such road or public way, which consent may be granted
without regard to the laws and ordinances of said County or of
