County, or any taxes which such Council in its discretion shall deem
necessary to levy, without limitation as to amount, for the construc-
tion, reconstruction, maintenance, improvement or drainage of
streets, roads or highways in any part of the County.
SEC. 4. Section 24-6, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:
24-6. Participation in cost of private developments.
The County Executive, on behalf of the County, may enter into a
written contract with any person, who is engaged in promoting a real
estate development or subdivision in the County, to participate in the
cost of street, sidewalk, gutter, curb or drainage construction in a
public street or road dedicated to the public use.
Sec. 5. Section 24-7, Chapter 24, title "Streets and Roads," of
the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:
24-7. Permit required for grading, etc., projects; fee.
Before any street, sidewalk, gutter, curb, grading project or
drainage project may be begun on a County road or street or within
the boundaries of a dedication to the public use, the applicant for a
permit to undertake any such project shall pay to the County as an
inspection and engineering fee, such fee as may be provided by writ-
ten regulation of the County Executive for the construction of any
such street, sidewalk, gutter, curb, grading project or drainage proj-
ect.
Any person who violates any provision of this Section shall, upon
conviction, be fined not more than one thousand dollars, or imprisoned
for not more than one year, or both, for each offense.
Sec. 6. Section 24-10, Chapter 24, title "Streets and Roads," of
the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:
24-10. Roads used for twenty years may be declared public high-
ways.
Whenever any road shall have been in use by the public for twenty
years, though the same may never have been condemned or granted as
a public highway, the County Executive may by written order declare
the road to be a public highway.
Sec. 7. Section 24-13, Chapter 24, title "Streets and Roads," of
the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:
