cash or corporate bond in such amount as is estimated to be the total
cost of the project. Such cash or corporate bond shall run to the
County, and be conditioned as follows:
(a) That the applicant, his agents and servants will
comply with all the applicable terms, conditions, provisions, require-
ments, standards and specifications of this Article.
(b) That the applicant, his agents and servants will
faithfully complete the work for which the permit is issued.
(c) That the applicant, his agents and servants will save
harmless the County from any expense incurred through the failure
of the permittee, his agents and servants, to complete the work as
required by this article or from any damages growing out of the
negligence of the applicant or his agents or servants.
(6) The applicant for such a waiver shall submit for re-
cording in the Land Records of Montgomery County, Maryland, for
himself and for all other petitioners for such waiver, in a form ap-
proved by the County Attorney, covenants which bind the applicant
and each petitioner and all of their successors in title to accept, as
against each of their properties which are adjacent to such road, any
future special improvement assessments levied for the construction of
such road, reserving in such covenants the right to challenge any
assessment in excess of the amount by which such property is special-
ly benefited by such construction.
Sec 2. Until December 7, 1970, the County Council may ex-
ercise the authority herein conferred upon the County Executive, pro-
vided that the Council first receive and consider the recommendation
of the County Manager. Failure of the County Manager to submit a
recommendation within thirty days of the submission of a written
request for waiver shall constitute a recommendation that the waiver
be approved.
Sec. 3. The Council hereby declares an emergency to exist. This
Act is necessary for the immediate protection of the public health and
safety.
Sec. 4. Effective date. This emergency legislation shall take
effect immediately upon enactment.
