and recording of the subdivision plat. Violation by the developer of his cer-
tification shall render all permits issued pursuant to such certification void,
in addition to all other penalties herein provided.

[(a)] (b) No [state,] county or municipal road, building or struc-
ture shall be constructed, relocated or enlarged within Howard County
until the plans therefor have been submitted to and approved by the How-
ard Soil Conservation District.

(c)   When deemed necessary by the Howard Soil Conservation District
or the Howard County Department of Public Works, a bond may be re-
quired to be posted as part of the permit with the Department of Public
Works to guarantee completion of the site in accordance with the ap-
proved plan of construction or to a condition that will provide minimum
erosion.

(d)   The issuance of a grading permit does not relieve the permittee
of securing any other permits that may be required.

3.503Inspection and Enforcement

(a)  Periodic inspections at appropriate stages of construction will be
made by the Howard County Bureau of Licenses and Inspections. The
Howard Soil Conservation District will provide technical evaluation serv-
ices as appropriate. The Bureau shall send a copy of final inspection re-
ports to the Howard Soil Conservation District.

(b)   The Council may adopt by Resolution, fees to be imposed for a
grading permit when it is determined such inspections and review impose
additional financial burdens on the County. Any fees imposed shall be col-
lected by the Bureau of Licenses and Inspections of the Department of
Public Works.

(c)  In the event that work performed does not conform to the
provisions of the plans and specifications as approved by the Howard Soil
Conservation District, or to any written instructions of the Howard Soil
Conservation District, a violation notice will be issued by the Bureau
of Licenses and Inspections. If recommended corrections are not complied
with, a stop work Order will be issued and the permit will be suspended
by the Bureau. After correction of the violation, an inspection must be
made by the Bureau before removing the permit suspension and allowing
resumption of work. In the event the required corrections are not made
following permit suspension, the permit may be revoked and any bonds or
cash deposits posted with the County may be forfeited to correct the
work as recommended by the Howard Soil Conservation District.

[(B)] (d) Any violation of this subtitle shall be deemed a misde-
meanor, and the Person, Partnership or Corporation who is found guilty of
such violation shall be subject to a fine not exceeding One Thousand
($1,000.00) Dollars or six (6) months' imprisonment for each and every
violation. Any agency whose approval is required under this subtitle or
any person in interest may seek an injunction against any Person, Part-
nership or Corporation, whether public or private, violating or threatening
violation of any provision of this Act.

[3.5033 3.504—Severability

In the event any portion of this Act shall be declared illegal, the re-
maining portions shall continue in full force and effect until otherwise
changed.
