(b) Within five (5) days after the effective date of franchise issued
pursuant to this Act, the Grantee shall file with the County Executive
and maintain on file throughout the term of such franchise a liability
insurance policy issued by a company duly authorized to do business in
this State, insuring Howard County, with respect to the installation,
operation and maintenance of the System.
1. For bodily injury, including death, in:
(i) the minimum amount of $500,000 for any one person, and
(ii) The minimum amount of $2,000,000 for any one accident,
and
2. For property damage in the minimum amount of $3,000,000, and
3. For damages resulting from any liability of any nature that may
arise from or be occasioned by any matter contained in or resulting from
the transmission of any communication over the Community Antenna
Television System, excepting Howard County programming on Howard
County Channels in the minimum amount of $2,500,000. The Council re-
serves the right to increase the amount of insurance coverage herein at
any time. Nothing herein is intended as a limitation on the extent of any
legal liability of the Grantee.
14.719. Security Fund.
(a) Within ten (10) days after the effective date of a franchise is-
sued pursuant to this Act, the Grantee shall deposit with the Director of
Finance of Howard County and maintain on deposit through the terms
of such franchise, the sum of Ten Thousand ($10,000) Dollars in monies
or securities and a surety bond by an insurer approved by the Executive
in the amount of $50,000 as security for the faithful performance by it
of all the provisions of this Act, and compliance with all orders, permits
and directions of any agency of Howard County having jurisdiction over
its acts or defaults under this Act, and the payment by the Grantee of any
claims, liens and taxes due Howard County which arise by reason of the
construction, operation or maintenance of the Community Antenna Tele-
vision System.
(b) Within ten (10) days after notice to it that any amount has
been withdrawn from the security fund deposited pursuant to subsection
(a) of this section, the Grantee shall pay to, or deposit with, the Director
of Finance of Howard County a sum of money or securities sufficient to
restore such security fund to the original amount of Ten Thousand ($10,-
000) Dollars.
(c) If the Grantee fails to pay to Howard County any compensation
within the time fixed herein or fails, after ten (10) days notice to pay
to Howard County any taxes due and unpaid, or fails to repay Howard
County within such ten (10) days, any damages, costs or expenses which
Howard County shall be compelled to pay by reason of any act or default
of the Grantee in connection with a franchise; or fails, after three (3)
days notice of such failure by the Grantee to comply with any provision
of this Act which the Executive reasonably determines can be remedied
by an expenditure of the security, the Executive may immediately with-
draw the amount thereof, with interest and any penalties from the security
fund. Upon such withdrawal, the Executive shall notify the Grantee of
the amount and date thereof.
