Howard County                                   2667

T. "Converter" means an electronic device which converts signals
to a frequency not susceptible to interference within the television receiver
of a subscriber, and by an appropriate channel selector also permits a
subscriber to view all signals delivered at designated dial locations.

U. "F.C.C." means the Federal Communications Commission.

V. "Effective Date of the Franchise" means the date upon which a
francise is granted by Howard County.

W. "Two Way Capability" means the subscriber or any other location
shall have the capability to choose whether or not to respond immediately,
or by sequential delay by utilizing any typed terminal equipment whatever,
by pushbutton code, dial code, meter, voice, video signal, or by any other
means, to any type of electronic, including but not limited to audio and
video, electrical or mechanically produced signal, display and/or inter-
rogation.

X. "Subscription Television" a system whereby subscription tele-
vision broadcast programs are transmitted and received, provided further
that the term 'broadcast' shall include cable.

Y. "Subscription Television Broadcast Program" a television
broadcast program intended to be received in intelligible form by members
of the public only for a fee or charge, provided further that the term
'broadcast' shall include cable.

Z. "Distant Signal Channel" means the channel or channels on the
Community Antenna Television System designated to carry signals from
stations located outside the mandatory carriage area or defined by the FCC.

AA. "Foreign Language Channels" means the channel or channels
on the Community Antenna Television System designated to carry pro-
grams in a non-English language, originated by stations in the United
States.

14.702    Franchise Grant.

The franchise to be granted by Howard County pursuant to this Act
shall grant to the Grantee, the right, privilege and franchise to construct,
operate and maintain a Community Antenna Television System in the
streets and roads of Howard County for a period of fifteen (15) years from
and after the grant and acceptance date of the franchise to be awarded
subject to the conditions and restrictions as hereinafter provided, and
further provided that the County Executive and County Council shall have
the right to review such franchise periodically at such time as the County
Executive and the County Council may from time to time elect to do so
and as hereinafter provided.

14.703    Acceptance of Authority to Grant Franchise

A Grantee of a franchise issued pursuant to this Act by acceptance
of such franchise expressly acknowledges and accepts the right of Howard
County to issue such franchise and agrees that it shall not at any time
hereafter challenge this right in any way or in any State or Federal
Court, provided further that in the event the F.C.C. or the State Govern-
ment acquires or assumes jurisdiction over the issuing of any Community
Antenna Television System (CATV) franchise the Grantee hereby agrees
that a franchise issued pursuant to this Act shall remain in full force and
effect as a binding contract between the Grantee and Howard County,
Maryland.
